To the OP , your friend can't stay but should she leave before she has incurred a ban and she has proof there was no fraud on her part in the current relationship she can be petitioned by someone new, even someone she has met while waiting for this mess to clear.

This will not be over quickly. You will not enjoy this.

What? No it means he's an honest person who isn't going to date the first pretty girl he sees and he wants a deeper connection. There's nothing wrong with that and I actually find it pretty refreshing given there are far too many people who treat their spouses as trophies.

Took me two years to find Alla and I lived in Ukraine. Then I found Alla quite by chance in Prague, CZECH REPUBLIC! Who knew? :lol:

I think that reply was given based on what the OP wrote. It sort of sounded like he is already doing the process and now he will only rethink it... ;) But if he is just looking now, it's perfectly fine :) marriage is definitely not something you should be rushed into!

It really does not matter if any paperwork was filed after getting married. An annulment erases the marraige as if it never happened. There will be no record of it, so in otherwords the marriage never existed so again she does not have a valid marraige to use as a way to obtain the greencard.

Not for immigration purposes. Yes specifically in the OP's case she isn't married so can't AOS but there was talk a while back about whether annulment (thus erasing the marriage) would mean that someone further in the process, say ROC, would have issues because technically if they were "never married" then wouldn't it mean their AOS shouldn't have happened? So anyway for immigration purposes annulment doesn't "erase" the marriage (just like if you get a criminal charge wiped from your record you still need to tell USCIS about it).

Thank you. So even if she has other people that will take her in and support her or something, that doesn't matter correct? She would have to go back, no other way to do it?

Even if she has somebody else she has to go back, the K1 will let her adjust only if she marries the person who filed for her.

Thank you to the person that realized its not me that brought her here and then dumped her! Yes, I have been to Philippines and gotten engaged once but it didn't work out. Since then, I just haven't found anyone else I felt I could be with for 30 years or more :) So I date and get to know them and go from there. Yes, I hope she won't have anymore troubles when she hopefully finds someone else to bring her back to the US. I know she is devastated and I think I would be also since she also went through and did all her paperwork and thought this guy was the one. There is more to it but I can't put her life on this forum. In the end, I would think anyone that went through all that would know what they wanted! Thanks for all the replies and I already told her she has no other choice...
