I 130 for spouse and child

For filing an I 130 for spouse and child I fill 2 I 130's one for each of them and send two checks for $420 each attached to each form with each of them having their own separate set of supporting documents. Am I right ? I want to send them all together in one package so that they get their visa together. Will I need two or one form 864 later on?

Are you a US Citizen and how old is your kid he/she might be a US citizen contact US embassy in your country to find out if your child is US citizen or not? It costs 205 dollars To get US passport and CBRA ( counsler report birth abroad )for your child and it takes upto a month or more to get the documents.

all is correct - 2 humans, 2 I-130's, 2 sets of documents.

Later, at NVC , the casefiles will be joined up together, so is only one fee for two I-864s.

thanks for the quick replies-He was born 2 months before I became citizen-so I guess the date of citizenship on naturalization would count and he was born 2 months before that.

Since your son was born before you took the oath of citizenship, you cannot file a CRBA and claim US citizen for your son. You must file an I-130 for your son. Once he enters the US on the immigration visa and gain LPR status, he automatically becomes a US citizen under the Child Citizenship Act. Once he immigrates to the US, you can file for a US passport to prove that he is a US citizen.

You will file an I-864 for your wife. Your household count will be three; you, your son, and your wife.

You will file an I-864w for your son. Since he automatically becomes a US citizen upon entry as an LPR, you file the waiver for the I-864. The "w" part of I-864w is for "waiver." You do not file an I-864 for your son.
