What is the process after your in the USA. I only know about AOS from being on this website.. But during this whole process no one has said there is anything else to do other than to marry within 90 days.. Is AOS required?

What are we suppose to do other than to get married?

AOS is required if you want be a legal resident, to work or travel outside the USA and come back.

If you have no motivation to work in the USA or be a legal resident or ever leave the USA and be under the thumb ICE for the rest of your life thats your choice. But you really should leave if you have no intention of becoming a legal lawful resident of the USA.

File AOS after your marriage. Then research removal of conditions and collect evidence over the next 2 years for that. Then when you file ROC look into filing naturalization or renewing the 10 year green card every 10 years.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Moved from K1 Process & Procedures to Adjustment of Status from Family Based Visas forum as this is the next step after arrival in the US on a K1 visa and marriage to the petitioner.

What is the process after your in the USA. I only know about AOS from being on this website.. But during this whole process no one has said there is anything else to do other than to marry within 90 days.. Is AOS required?

What are we suppose to do other than to get married?

AOS is required if the beneficiary wishes to obtain a green card. An I-485 will have to be filed and the AOS fee is $1070.

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

When you get to US, apply for Social Security about two weeks later, finish wedding plans and get married, get a rush on documents, apply for AOS, AP and EAD at same time. Enjoy more paperwork.

After the I-94 expires you are out of status. If you don't adjust you remain out of status, can't work and won't be allowed re-entry in to the US if you travel abroad.

A question for the more knowlegable...Does out of status eventually become unlawful presence for the spouse of a USC?

Out of status is unlawful presence from day one. People here say "out of status" to seem nice or something, but there is no difference between that and illegal presence.

Out of status is unlawful presence from day one. People here say "out of status" to seem nice or something, but there is no difference between that and illegal presence.

This is not the case, in no way is an 'out of status' situation unlawful. Please do your homework & quote only facts for answers, not what you've heard/read or indeed, your personal unsubstantiated thoughts. Thankyou

No, you're wrong------ Taken from the uscis website -

After the Fiancé(e) Visa is Issued

Once issued, the fiancé(e) visa (or K-1 nonimmigrant visa) allows your fiancé(e) to enter the United States for 90 days so that your marriage ceremony can take place. Once you marry, your spouse may apply for permanent residence and remain in the United States while USCIS processes the application. For additional information, see the “Green Card” link to the right.

Do you note the word 'may', not 'has to', or 'must', but 'may'. Please understand i know my stuff, being 'out of status' currently. Nowhere on their whole site does it mention being 'out of status' means being here illegally, prove otherwise. Thankyou

You have justified your thoughts by rightly stating that the person wasn't allowed to enter back into the USA. This has nothing to do with being here in the USA (& never leaving these shores) unlawfully, this was your point. I'm here in the USA, I'm yet to start my AOS journey but have been here 16 months volunteering (arrived on a K1 VISA) at my USCs wifes workplace. I am not here illegally/unlawfully, can you see that? Thank you

p.s, I see your confusion & it's making you look foolish- You're getting the word 'overstay' confused with 'unlawful'! Hope this makes it clearer for you. Thank you

If you met the terms of the K1 by marrying before the I-94 expiration date (90 days), then you are eligible to adjust status. However, if you don't AOS before the I-94 expiration date you are in unlawful presence.
