CR1 processing time

Timeline

Yesterday I found on this website, CSC( california service center) is working on Oct.9 2011 CR1 case, but our case receipt date is Oct.7 2011, we still did not get any decision from USCIS, I am very worried about that, but I don't know what should we do next step? there must be something wrong with our case, as I know USCIS deals with cases with sequence, is there someone could give me some suggestion on how can I get some information from USCIS? our attorney is just every helpless, always ask us to wait, I don't know how long we still have to wait?

Have you called USCIS? You filed a I-130 petition am I right? Its taking USCIS around 5-6 months to process this type of petitions. You should be getting a response by now. Have you been tracking your case on the USCIS website? I would call them and find out what's going on.

yes, I check the status everyday, it's always initial review, and we called several times to USCIS, they always say wait for another 2-3 weeks. it's very frustrating.

yes, I check the status everyday, it's always initial review, and we called several times to USCIS, they always say wait for another 2-3 weeks. it's very frustrating.

I understand, but you right there! As the other poster says you should be getting approved very soon.

Finally we all three together. We are happy :)

No, they are not. Are you out of processing time as defined by USCIS?

the defined time is 5 month, ours is more than 6 months. and USCIS website says they always deal with cases with sequence, as it's the only fair way to applicants.

One more time, they not doing it "in sequence".

USCIS strives to process all cases on a first-in first-out basis

Sure. but there is no guarantee. "Strives" is a key word here. They only "strive", they don't "do". Some applications are approved faster, some have to wait a little bit longer. There is no way to tell.

Now, if yours is in fact out of USCIS stated processing time, call them one more time and ask for "service request because of out of processing time".

If the clueless Tier 1 operator tells you to call in 30 days, firmly request to speak with Tier 2 or supervisor. Don't hang up until you service request is placed.

They DO NOT go by what the website days. If you try to call USCIS, they can tell you which date they are currently working on. Now, that doesn't mean that they haven't approved petitions AFTER that date, but if they have gone past your priority date, then you could put in a service request.

Our NOA-1 was on October 4, and we got approved just last week - 6 months and 1 day.

10/01/11 - Filed (2) I-130's

10/04/11 - NOA-1

04/05/12 - NOA-2

Your I-130 was approved in 184 days from your NOA1 date.

NVC

04/23/12 - NVC received both cases (18 days/12 business days from NOA-2)

05/07/12 - Case numbers and IIN's (14 days/10 business days since NVC received)

05/07/12 - Sent out DS-3032 by email; auto-response received

05/08/12 - AOS fee invoiced, paid - "IN PROCESS"

05/09/12 - AOS fee shows as "PAID"

05/10/12 - Spouse's DS-3032 accepted; minor child's rejected = had petitioner call NVC = received verbal acceptance from operator

05/11/12 - Spouse's IV fee invoiced

05/14/12 - Daughter's IV fee invoiced, paid both IV fees - "IN PROCESS"

05/15/12 - Both IV fees show as "PAID"

05/16/12 - Sent both AOS and both IV packages to NVC via USPS (expected delivery: 05/19/12)

When next you call into USCIS, ask for a Tier 2, an ISO.

Then when you get one,

ask if the casefile has made it to an adjudicator yet, or not made it to an adjudicator yet.

Don't fiddle around with a CSR, the first person that answers the phone - an ISO can tell you what's what.

Yer JUST PAST the 6 month window - don't fret so much, aye?

Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.
