Canceling I-864 reconsidering my decision

Did you ask to speak to a supervisor? The person who answers the phone is a call center employee and doesn't work for USCIS

I suggest you make an Infopass appointment to see what is going on. Bring a copy of the letter you sent. If they won't discuss the case with you, you can at least give them the letter (again) in person and know it has been received.

I spoke to them again and got an agent who was more helpful. Basically he stated that their systems don't track letters that are submitted related to cases. HE said all I can do is that that If I have mailed them withdrawal of I-864 and I-129F and It gets attached to the file but he has no way of verifying. IT seems like he is saying that my job is send in the letter of withdrawal and there is no way of keeping track of if they recieved it.

I will make an INFOpass appointment and see if they provide me with better answers.

Yes, it should. In that case, USCIS definitely received it, it is just a matter of if it got matched up with your file. Most likely it did, but if you can be sure that would of course be better.

Have you received any notice about where the case is processing? (California Service Center vs local field office?) If you receive an interview notice then you can not go and your wife will be denied.

The case was transferred to CSC and it says "Initial Review" when I check the status on USCIS website as of now. When I mailed my letter of withdrawal I864 (affidivat of support) I mentioned receipt number, A# my full name, spouses full name and mentioned that marriage not viable due to abuse with no chance of reconcilation and process of working on a divorce attorney, I also mailed a copy of Notice that says the application/petition AOS I485 is being tranferred/processed at CSC.

I also wrote a 2nd letter asking them to withdraw all support petitions that I send for I129F to be on the safe side.

I think I have done everything I have been told and just to be on safe side I will make infopass so that I can talk to an agent at my local office in washington DC hoping they can look up any information regarding my letter of withdrawal.

Sounds like you have it under control. Since it's at CSC I would definitely do the Infopass just to be sure, since applications at CSC are generally approved without an interview.

I hope that CSC won't approve her PR without interview after seeing my withdrawal letter? that would be very scary ignoring my letters.

They take it seriously if they get it. The risk is in if it gets lost, forwarded to the wrong person, not put in the file, etc.

Agree with the above. They take it seriously but there have been instances where they make the mistake and issue the card. in the case I'm talking about the girls husbands got his card anyway and even though she got angry and said she had withdrawn they said something like now that the card was issued they couldn't do anything. Basically they were trying to get her to drop it 'cause they stuffed up.

I have submitted letters requesting CSC which is processing my spouse's pending AOS based on K1 case to withdraw my I864 submitted with I485 and also the one submitted with I129F visa.

My letter was very simple requesting the withdrawal and explaining that my spouse married me for greencard offcourse listing her A number her name msc number etc.

Do I need to send any evidence to support my beliefs? All I have is verbal conversations where she admitted that she married me for green card so she can help her lover back home to come to USA and marry him one day.

I am unable to file for divorce becuase my state needs 6 months of seperation before filing anything with the court.

Please advice of how I should approach a matter like this? Would my letter be enough becuase I hear once you sign the affidivat she can get the benefit of the doubt.

It is enough to request that the I-864 be withdrawn,

or rather, to state clearly that you are withdrawing the I-864, Affadavit of Support.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
