Adopting my Niece from Nicaragua

My Husband and I are in Nicaragua now and we decided during this trip that we want to adopt our Niece. This is something we have been thinking about and the connection with her is wonderful. Her parents want this too. Nicaragua has an open policy and I know of people that have adopted children from living parents with waved consent. I'm just starting my research and I'm looking at the I-600 form and the steps required. I'm reaching out to see if any one knows of good adoption sites with information or if anyone has had experience with this process. Not sure if I should file the 600 or 600a form to get the process started. Thank you in advance for any feed back.

I am in the same situation. I want to adopt my nieces from colombia.

so their mom doesnt have to struggle as much anymore and i also dont know where to start

with that being said,i personally am seeing our immigratation lawyer for advice and steps.

I will update you on what i find out.

N-600 is for children living in the USA. Not the correct form for you guys.

You need to wait for the adoption to be final before filing anything for US immigration.

You would look at the N-600K for a child outside of the USA who is fully adopted.

Nicaragua requires the parents to stay in the country with the child for a certain amount of time during the adoption and all this. You should read up on their rules, if they aren't followed then the adoption wont be granted. No N-600K until the child is fully adopted and the final adoption papers are in your hands.

N-600 is for children living in the USA. Not the correct form for you guys.

You need to wait for the adoption to be final before filing anything for US immigration.

You would look at the N-600K for a child outside of the USA who is fully adopted.

I see. I was looking at the I-600 is that different from the N-600. I read some where a I-600 from the US was helpful.

The child is not an orphan how would you prove death of both parents if they are not dead?

Yeah def. i think i can add you as a friend on here. I did my i-485 alone but looked for a lawyer because my husband has some legal issuses in 2008. anywho. long story short my lawyer and i are very cool. he doesnt charge me to ask questions. so i am gonna take advantage lol.

In Nicaragua they can fill out a wavier giving up the child. I know of three children from the same family that have been adopted in the states this way. I'm in the process of contacting a women in California that adopted one of the children. My Brother-in-law and his wife want to do this so our Niece can join our family.

Adopting a niece is one thing. Being able to get her an immigration visa is another thing.

In order to get an immigration visa, one of two requirements must be met; 1) adopted child lived with adopted parents for two years where adopted parents had primary control of the adopted child, or 2) the child is classified as an orphan. If you can't meet one of this, then no immigration benefit.

No one can petition for a niece. People think they can get around this by adopting family members. US parents for immigration purposes, and the child still maintain relationships with their biological parents. Only reason for adoption was solely to bring niece to US. USCIS does not allow this.

I made no negative assumptions about your motivations. I gave you the facts. You must meet one of the two requirements to get an immigration visa for your niece. If you cannot meet one of the requirements, then the immigration petition will be denied. Best of luck on your journey, I hope you meet one of the requirements.
