Hi, I am just picking up on a comment regarding 30 days being the minimum a couple should spend together to be approved as I have been following posts on this website for a few months and this is the first time I have heard this so wondered if someone could clarify.

the requirement to obtain NOA2 for petition approval is proof of meeting in the last two years. that's it.

at the visa interview, you'll want to be able to provide enough evidence as a couple, overall. communication and visit evidence help do this. but there is not standard requirement for the number of visits. the consulate might not take you seriously if there's only been one visit, but even this doesn't mean a denial necessarily.

i agree with you, If elvis and I don't get approved i am prepaired to not come back to the U.S.(L) Elvis is my everything so life without him is not sensible to me nor will I allow it to happen. (L) I hate that we have to prove to strangers how we feel about eachtoher. Its not fair at all. I understand all the fraud that is out there but again like the girl said before 1 week APPROVE 5 years denied....& then i also hear these people are so freakin mean!!!! Grrrrrrrrrr!!!! :angry:

I would have married my wife in Vietnam and filed a CR1 petition. If that was denied then I would have moved to Vietnam to live with her while we went through the appeals process. If we had exhausted all possible chances of getting a visa then I would have lived in Vietnam the rest of my life.

PLAN B is to make sure PLAN A works!

It is about split between those that think that getting married is the cure and those that do another CR1, the key is time together either way. It seems that 30 days is the minimum for an approval.

What approval are you talking about? I STRONGLY believe everything is on a case by case basis.

If you cannot prove bona-fide relationship because the Embassy feels you guys have not spent enough time together "in person" and denies your K-1 VISA, what would you do? Would you start all over from scratch, or would you try for the IR-1/CR-1 VISA? :unsure:

i will be broken hearted :crying: :crying: :crying: lol i will marry my fiance and file for spouse visa instead lol nothing or no one will be in between me and my fiance...only god will but no one else ehhehe

The longer it takes to happen the more you'll appreciate it when it does!

Me too. I fell in love with him before I met him in person. But the United States don't want foreigners defrauding their subjects/country, especially since Nigeria is flagged for fraud. I going end up making a substantial sacrifice, because I have a feeling they won't approve us since I only spent 4 months (2 visits 2 months) with him.

That's our Plan B. I did my best to load up and put the best story of our relationship. Right now we don't even care where we live as long as we are together. But I think we will be cool.

And the being together formula who knows. I guess besides time together just their idea of what they think an evolution of a relationship yes. I know its not lots of pics. I know couples who did hundreds in different outfits all in one day. They had quantity no quality. So that proves nothing. I personally really believe (IMO) its a little what yo presented up front and alot how the beneficiary presents themselves.

I would move to Russia and marry Sveta to be with her, even if it meant that I would never get to see my family again. I love my family, but she will always come first in my life. It's very scary to think about not being approved at any step...

The US Consulate won't change their decision just because the K1 applicant had the visa denied and then got married. What needs to change is the situation regarding spending time together and not just the marital status!. For example after the K1 denial increasing the number of emails and phone calls won't change the situation, having 200 hundred pages of chat or thousands of phone calls it doesn't show a genuine relationship either. They want to see more than online relationship.

I saw several cases people from Russia, China,Brazil,England,Canada etc.. the couple met each other twice, applied for visas and they got their visas without any problem, but US Consulates in Nigeria,Ghana,Ivory Cost,Vietnam they use to deny most of the visas due very high rates of visa fraud.

Until the interview visit him at least four,five times and spent a few months together otherwise the odds will be against you.Good luck.

We were going to do 2 and switched to 1. So we would have reverted to 2.

I was just curious whether this was time spent in the two years prior to sending the I-129F or until the point of aproval of the K1 visa at the embassy? I have dated my partner on and off for 13 years but we only got back together in December 2011 and from then to filing the I-12F last month I have done 3 trips to the US so far but due to work commitments I am not able to take much vacation time so the three trips only amounted to about 25 days total. But I plan to visit every 10 weeks or so for about a week until we are closer to the embassy stage so that number will increase quite a bit. I was wondering if people have had RFE's or problems with this as it didn't specify a minimum amount on the form? Any thoughts would be appreciated. Thanks for your time.

I have followed the people through Lagos for some time and noticed who fails and who gets through. The success of people that have spent 30 or more days together have a much higher percentage of approval than couples with less red flags and less time together. In a high fraud consulate they want to make sure you have had time to get to know your SO real life. Online a man can be a woman, face to face they can pull it off for a while, over time you are going to notice that something is wrong with that you believed.

This will not be over quickly. You will not enjoy this.

We have gone through a denial. It took 2 months to get the letter to tell us why. In the mean time we figured it out with the help of good people here on this site. We went ahead and followed our instincts. Sent away a new petition with what we felt was the reason. When we got the letter of denial we had guessed correctly. So we are thinking positively and feel we are on the right track this second go around. I have to say when we received the denial by email I felt sick to my stomach, cried for a few days and thought our world was crashing in. It took a few days to sort out what had happened.

Moral of this story...

Suck it up figure out what went wrong and make it right...

The only acceptable outcome is to be together and do what has to be done to make it happen.

I don't think I have to live in US to be happy, but I definitely have to live with Jorge to be happy! Otherwise what's the point?

If you get denied b/c you don't spend enough time together, then why wouldn't you just go ahead and spend some more time together before round 2?

No not necessary 30 days I have been with my fiancee for less than that we got approved so dont worry about that. every case is different and they can tell which relationship is real and which is not. other thing u are from UK u shouldnt have any problems interview at your embassy are very easy since its not a high fraud countries! good luck

Well, I don't believe in a numbers of visit to get your K 1 visa approved at the embassy stage. Every cases is different. It's not what people say or what you think, but it is what the consular officer think and their decision that matters. As I am very sure that the consular officer can distinguish between fraud and genuine relatioinship, if one get denied there must be something wrong on their case either they messed up with the paperworks or one just get lost at the interview, but still there are more than this that one is not qualify for a K 1 visa.
