Hi all,

I need a little help. my husband and I are ready to send the I-751 package. This is what has been included I need opinions please.

Cover letter

I-751 form

Permanent resident card copy front and back

Copies of tax returns and w2s 2010 and 2011

Bank statements for savings and checkings (only one I found from last year and the rest this year

Car insurance and bills joint

sworn affidavits from 2 people (notarized)

Copies of previous joint health insurance and current dental with bills showing me as beneficary on policy

copies of both drivers licenses showing same residence

copy of newborn son's birth certificate

lease agreement

Do you think this is enough evidence? OR we might get an RFE or interview request??? BTW, his green card expires july 20 do we send in the package april 20 or send it a few days earlier to make sure that Vermont receives on april 20

3 months from expiration.

If his GC expires on 7/20, 90-day window opens on 4/21. Don't date your petition or send it even one day earlier.

Not adjustment of status, moving from adjustment of status to removal of conditions.

I also sent photographs from various days over the previous two years. Your evidence looks good! I would not mail it until you're within the 90-day timeframe from the GC expiration.

You should send the package after 04/21 otherwise you will be denied. USCIS calculates with this app, follow the link, http://www.uscis.gov...Calculator.html

The window opens on that day, it does not mean you have to mail on that day. If I were you, I would wait for IRS Tax Transcripts & send the package.

USCIS only accepts offical IRS Tax Transcripts not other copies of Tax Return. You fill this form & mail it, you will probably get it in 3 weeks. You can obtain this form from this link

Don' rush anything, gather all documents & mail ROC otherwise you will get a RFE, you don't want that, believe me.

Any where you are both listed as each other's beneficiaries, 401k life insurance...any trips you took together. utility bills if on both names, credit card statements if you have joint CC. I second everybody regarding sending it early...sending a day late won't really do much except you get the relief that it is out of your hands, but sending it a day early could mean denial so why take the chance. Best of luck.

Question:

My I-751 form was signed and dated 03/28/2012.

90 days window opened on 03/31/2012.

But I only sent it on 04/02/2012 to be within the 90 days window.

So does the I-751 form signed date has any impact on whether USCIS accepts the ROC petition or not, like filing too early before the 90 days window?

I thought the date that USCIS received the ROC petition would be considered as whether the ROC petition is filed within the 90 days window or not.

First of, you worry too much & don't be paranoid about it.

You are fine, per USCIS receiving date is important, not the date you signed.

hmm I submitted copies of our tax return...I filed in september so no response yet but I was wondering where did you get the info that USCIS only accept IRS transcript....I might have to send them seperately! thanks.

Personally, we just sent in copies of our returns from Tax Slayer. We were approved without an issue.

Commas are you friend!! I had a tough time reading what you posted above.

I think your evidence looks good, but would recommend that you apply to get the tax transcripts. I called and mine arrived only 5 days later. Since you cannot file until 4/21 anyway, you should have time. As another explained, your window opening doesn't mean that you have to file on that date! Many people file weeks or a month or more after their window opens.
