Birth Certificate Trouble? IR5 Mom's bday

Hi guys,

I am actually not sure if I am going to have a problem in the future or not. I just want to cover everything before I process her papers.

1st: In my birth certificate my mom's name is Ma. Linda W. Dimla, Her birth certificate says (maria linda w. dimla ) and in the bottom it says that she is married to my dad ( she was not)

2nd: She is now married so her last night has changed since so her name in the marriage certificate is Ma., Linda W. Dimla and became Ma. Linda D. Naguiat she took her husbands last name.

When she was applying for her passport she needed her birth certificate she found out that in her birth certificate her name and birthdate was MARIA LINDA W. DIMLA and her birthday was Sept 24, 1968

She has always celebrated August 15, 1967 as her birthday (this is the same birthday that was shown on her marriage certiicate)

With this, she acquired an affidavit from an attorney that she is the one and the same person.

Will I have a problem? is the affidavit sufficient?

Are you a USC?

1st: I doubt anyone will notice the discrepancy in names, as Ma. is an abbreviation for Maria. As for the mistake on your birth certificate, is there any way possible you could get it corrected? If not, you may consider submitting a statement explaining the mistake with back-up documentation that she wasnt actually married previously (CENOMAR?)

2nd: Same thing about the discrepancy in birth dates--can she get it corrected? Not sure what kind of affidavit from the attorney you are talking about. If you just went to a random attorney and asked him to fill out an affidavit saying she is the same person, they may not care about it. Again, I would consider including a statement explaining the mistake if there's no possible way to fix it. You may require additional documentation of your mother's identity and relationship to you, so gather up anything you can.

Is it common to have a lot of mistakes on official records in the Phillipines? Maybe USCIS has seen this all before.

Hi almost a USC i guess ahah I'm just waiting for my interview.

I am not sure how it's going to get corrected, but I will ask my mom about it.

The names are not really different so it shouldn't be an issues. As noted above, Ma. is just an abbreviation for Maria.

The DOB should be corrected, you can do that through the Philippine Courts or the NSO. Probably should talk to a PHIL attorney about that.

The marriage listed on your birth certificate is not relevant to an IR5 visa. The relevant issue on the IR5 is whether you and your mother are legally/biologically. I doubt they'll even ask about that, but if they do she should just tell the truth. It is fairly common for people to invent marriages when registering children, especially prior to 2004 when the law changed. Prior to 2004, a child could not carry their father's surname unless the parents were married. Now, the father just has to acknowledge the child by affidavit so people are less likely to make up marriages now.
