hi! I would appreciate your opinion if you think the following evidence proves residency in Italy for DCF of I130, I have to decide whether to file in US, or wait for my residence permit and file in Italy. thanks!

5 September 2011 : arrived in Germany from USA, entry passport stamp. obtained German permit to remain in Europe 6 months instead of the normal 3 months allowed. German permit is valid in Italy too and is put on the passport like a visa.

28 December 2011 : arrived in Italy. email receipt of flight ticket German-Vienna-Milan (Italy). email receipt of hotel, 1 night in Vienna.

February 2012 : copy of certificate sworn in front of American Consul in Milan (part of getting married process)

March 2012: copies of certificates sworn at Italian Courthouse, local townhall and wedding cerimony in townhall, request of residence permit at local police station

likely May or June 2012 : will obtain residence permit, picking it up at local police station.

full copy of passport will of course show no stamp of other countries since arrival in Germany in 2011.

also, do you know if they reject the DCF and direct you to file in US, if the I130 fee is refunded or lost.

Contact the USCIS in Rome and ask what constitutes proof of residency

I did contact them but they declined to give me a clear answer. I guess we'll file to US though we live in Italy. they did say the fee is lost if they tell you to refile in US.

I would vote for filing DCF. First of all, it's generally much faster & easier than US-filing! Do you know how long you'll need to wait for your Italian residence permit? I had a similar situation here in Germany, and the US Embassy in Frankfurt recommended I submit my now-expired student visa, my current residence permit, and our "city registration" form required in Germany as sufficient evidence. With the amount of info you already have I think you'd be much better off waiting for your Italian residence permit & circumventing the US-filing process!

Pre-VISA

November 14, 2009 - met randomly in a park in Atlanta, talked 1 hour

November 16, 2009 - started emailing daily

December 11, 2009 - flew to DC for a weekend to visit

January 5, 2010 - JL flies back to Germany :(

March 17-23, 2010 - I visit JL in Germany

September 1, 2010 - I move to Germany!

September 9, 2011 - Married <3

German Visa

December 20, 2011 - applied for German visa

February 9, 2012 - interview

March 26, 2012 - temporary 18 month greencard!

US VISA

April 3, 2012 - mailed I-130s to Frankfurt

April 11, 2012 - NOA1 mailed

April 13, 2012 - I-130 payment authorized

April 18, 2012 - NOA1 received

Impatiently waiting for NOA2......
