Hello!

My husband (US citizen) and I (non-immigrant visa) are in process of filling out all the forms required for AOS.

I have encountered a few questions I have doubts about.

Sorry if they have been asked and answered.

1) Form I-130

C-21 Last address where you lived together

If we currently live together, do I state this current address or the previous one (we relocated from Portland to Chicago, so I'm not sure whether I should put the last or the current address).

2) Form G-325A

Question about parent's DOB and current residence. What do I put if one of my parents passed away?

3) G-325A (my husband's)

The application is associate with AOS for my husband, isn't it? Even though it's not his AOS. Or do we tick other and specify that it is for his wife's AOS?

4) I-485. Part 1. Expires on...

Do they refer to my visa or I-94?

5) I-485. Part 2. Application Type: Why are you submitting for AOS.

We are submitting I-485 together with I-130. So do I go as an A (an immigrant petition giving me an immediately available immigrant visa number which has been approved) or b (My spouse or parent applied for adjustment of status...) ?

I guess I should go with A but I don't have that number yet.

6) I-485. Processing Information. Part C. List your present or past membership in or affiliation with every organization, association, party, club, society, etc.

I'm confused about this one. I have a degre from a US university plus I volunteered for some organizations, had internships and were a member of some university clubs (graduate student association) and academic associations (for slavic studies). Do I need to list all these?

7) I-485. Part C. Question 11. About J1.

I used to have a J1 visa (doing Fulbright scholarship) and have met the 2-year requirement. Should I specify it in the cover letter? Do I prove it with color copies of customs stamps?

8) I-131. Part 1. Information about you. Class of Admission?

Are they referring to my current visa status?

Also, as a nonimmigrant visa holder, do I apply for advance parole?

9) General question. My Medical was performed in Portland, OR and on the form I have a different address. Does it matter and do I need to explain it?

Thank you in advance for your answers. I would truly appreciate your help.

Natalia

1. Last address is current address

2. Put patent DOB and "Deceased" for address

3. AOS G-325 is only for beneficiary and other should be checked. Write I-485 beside it. AOS for I-130 needs G325A for both petitioner and beneficiary.

4. The question refers to the one preceding it. If that question was about visa the answer is about the visa; if it were about I-94, the answer is about the I-94.

5. You are filing concurrently so it's A.

6. List all of them

7. Don't know. I have to look at that question.

8. Yes, they need to know your current visa class. If you are out of status you cannot apply for advance parole

9. It doesn't matter where you had it done as long as it is a civil surgeon and was done recently

For question 7 you need to copy your visa. You do not have to state what you are adjusting from on the cover letter. It seem as if it expired. That is okay.

1) Form I-130

C-21 Last address where you lived together

If we currently live together, do I state this current address or the previous one (we relocated from Portland to Chicago, so I'm not sure whether I should put the last or the current address).

List your currant address in Chicago

2) Form G-325A

Question about parent's DOB and current residence. What do I put if one of my parents passed away?

List parents name and DOB, for currant address put "deceased"

3) G-325A (my husband's)

The application is associate with AOS for my husband, isn't it? Even though it's not his AOS. Or do we tick other and specify that it is for his wife's AOS?

Not sure what you are asking here

4) I-485. Part 1. Expires on...

This is the date your i_94 expires (90 days from your arrival in the USA)

Do they refer to my visa or I-94?

You need to include a copy of your I-94 front and back

5) I-485. Part 2. Application Type: Why are you submitting for AOS.

We are submitting I-485 together with I-130. So do I go as an A (an immigrant petition giving me an immediately available immigrant visa number which has been approved) or b (My spouse or parent applied for adjustment of status...) ?

I guess I should go with A but I don't have that number yet.

not sure on your type of visa

6) I-485. Processing Information. Part C. List your present or past membership in or affiliation with every organization, association, party, club, society, etc.

They are looking for any type of origination's or clubs you have belonged to, like militant groups or ???

I'm confused about this one. I have a degre from a US university plus I volunteered for some organizations, had internships and were a member of some university clubs (graduate student association) and academic associations (for slavic studies). Do I need to list all these?

Yes list them :)

7) I-485. Part C. Question 11. About J1.

I used to have a J1 visa (doing Fulbright scholarship) and have met the 2-year requirement. Should I specify it in the cover letter? Do I prove it with color copies of customs stamps?

I do not know on your type of visa :(

8) I-131. Part 1. Information about you. Class of Admission?

Are they referring to my current visa status?

They are asking your class of via, mine was a K1, fiancee

Also, as a nonimmigrant visa holder, do I apply for advance parole?

If you want to travel outside the USA--yes you need it, for the dates put "to be determined"

9) General question. My Medical was performed in Portland, OR and on the form I have a different address. Does it matter and do I need to explain it?

If it needs to be explained, they will ask you in the interview :)

Thank you all for your comments and answers!

I just realized that I posted the topic in the wrong group. I'm currently on a B1/B2 visa. I had a J1 back in 2007 and since it expired I lived in Russia for more than two years. I'm just not sure how upright I should be about it - I mean do I push this information showing that I indeed fulfilled my 2-year rule, listing all my trips abroad and stamps showing arrival/departure to my home country? Or will they figure it out themselves?

Thanks!

I also have a follow-up question on affiliations/memberships.

Since ther doesn't seem to be a lot of space, would it be ok if I put them diwn in ink, even though the rest of the form will be typed? Or do I just need to include the attachment sheet and state on the form see attachment?

Thanks!

3) G-325A (my husband's)

The application is associate with AOS for my husband, isn't it? Even though it's not his AOS. Or do we tick other and specify that it is for his wife's AOS?

Not sure what you are asking here

We are submitting G-325A with I-130. They ask what this form is associated with: 1) Naturalization, 2) Status as Permanent Resident, 3) Other (Please Specify).

As far as I understand, in my G-325A I choose 2) Status as Permanent Resident.

Does my husbant choose the same option or Other (and Specify that it is for his wife's petition?)

Thanks!

3. AOS G-325 is only for beneficiary and other should be checked. Write I-485 beside it. AOS for I-130 needs G325A for both petitioner and beneficiary.
