Travel back and forth to Canada with Fiancee Visa

So If we get approved and my fiancee he is from Canada he lives there but is not a citizen of Canada. I am wondering for marraige purposes for our families to get the wedding preparations and stuff he will need to travel back to Canada is it possible will he be able to re-enter US before we get married? How do we manage the situation? How can he travel back to Canada and re-enter to get married? Can he travel back and forth for the 90 days? or does he have to stay in US until we are married? What is the best way for our situation. Also he is only coming to US to get married to me because my family is here, we plan to settle in Canada and I would travel to US to see my family when I want to.

Your Fiance is Canadian, and your question is........ if he can travel, back and forth to Canada, AFTER he had entered the US with his K1 VISA? If so, the answer is NO. He will not be able to travel outside of the US until an Advance Parole travelling authorization has been issued, or until he has his green card in hand.

With a K1 visa the beneficiary can apply for a single admission to a US port of entry within the validity of the visa. The petitioner (USC) and the beneficiary (alien citizen) must marry within 90 days of your single entry into the US.

Uuuuh if your intent is to both live in Canada, the K-1 route was unuseful!! You can get married when he's coming as a tourist, as long as he comes back to Canada then! Your plan doesn't look like you want him to immigrate and come live in the US!

Re-read the K-1 visa purpose.

If his intent was to get married and come live in the US with you, K-1 would have been the solution. He would then file to adjust his status (AOS) and file for an Advance Parole which is a document that will allows him to travel while his AOS is pending. The AP takes about 2-3 months to get.

From what I understand your purpose is: getting married in the US and relocate to Canada, a K1 visa is not what would have best suited you.. He could have just travelled to the States, get married and leave (if I am not wrong), as his intention is not to immigrate to the US.

You could have saved a few $$..

He did not get a visa to US they thought he wanted to live here. So that is why we did the Fiancee Visa. What is the advance parole, how long does that take? is that after marriage correct?

My Fiance is not Canadian, he is Pakistani and been living in Canada for past 10 years. Unfortunately he is a a permanent resident and US did not give him permission to enter.

I see, well he could just enter the US with K1 visa once you know you can get married within 90 days. Once you get married you could just move to Canada as you do not want to adjust his status since you will be living in Canada. Advance Parole would need to be requested after the marriage when filing for AOS. Hope it is clear.

Ya I understand that part, I was just wondering about how we were going to manage his family especially since he would have to be away from them. So basicially once he is here he cannot leave until we are married. Can he come back after we are married, maybe we can do our other cultural ceremonies after marriage.

I doubt they will let him come back after you guys have moved to Canada. K1 visa in a one-way entry to the US with the purpose of getting married in the US within 90 days. Hmm it's quite tricky in your case, but I do not have such a big knowledge on other visas or options you might have.

As others said, K-1 visa is a single entry visa, so if he leaves before or after getting married (and in this last case, with no AP or green card), he will need another visa to come back.

I think that would have been less trouble to plan the wedding in Canada.

I am not sure but there might be a chance it would be easier for him to get a tourist visa once you are married, altho they could still question the fact he wants to immigrate. Not sure tho.

Be also aware that he might have to go through Administrative Processing before getting issued a visa, a lot of men from Pakistan/India etc seem to have to go through it, maybe have a look in the forum related to Pakistan.

OP, if you want to settle in Canada, the entire K1 process doesn't make sense. You should have planned your wedding in Canada from the beginning and your family could have easily traveled there to attend.

You need to start looking at immigration to Canada. You cant just up and move there you have to go through a process.

Also He will have to go through AP even though his interview is in Canada because he is a Pakistani citizen. Being a PR of Canada or a Naturalized citizen of Canada wont stop them from mandatory AP for that country.
