Hello All,

First of all, I would like to thank everyone who has put together this site. It has been a HUGE help for me. My question is aout the K2 visa process. While, your site has given me a clear understanding of what a K1 requires, I cannot find many details about the K2. My questions are:

1. Do I all I need to do is add the child's name to the I-129F form that I am submitting for my fiance to get a visa?

2. Are there any other forms I would need to fill out and submit for the child?

3. Do I need to send copies of the child's passport and birth certificate as well?

4. Is there an additional fee I need to pay at this point?

Any help that could be provided will be greatly appreciated.

Sincerely,

Andy and May

1, Yes list the child.

2,3,4, everything is done at the US embassy level, the fees and forms are done then, with supporting documents. The medical is also done at that level too.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

List all the children, regardless of their immigration intents.

2. Are there any other forms I would need to fill out and submit for the child?

You'll list the children that you wish to receive a K-2 visa on the DS-156K, which is for the interview.

3. Do I need to send copies of the child's passport and birth certificate as well?

No, but needed at the interview.

4. Is there an additional fee I need to pay at this point?

No, the child will need their own medical and visa fee, again near and at the interview.

Any help that could be provided will be greatly appreciated.

Sincerely,

Andy and May

2. List the child(ren) on the I-134, and check with your consulate about preparation requirements of I-134 for child(ren)'s K-2 visa application.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

The embassy will require a letter from the father of the child allowing the child to leave Thailand. They will require this in both languages. Many times they also require the parent to come into the embassy to be interviewed. Request a copy of the sample letter from the embassy.

A letter from the dad is not needed, if mom has a court order from the Thai court giving her full custody of the child. The document needs to be translated into English. We did not have to deal with the children's father at all.

Then you assume this person has such an order & that the embassy will accept it as they did in your case. In two cases I know of they would not accept the court order but I do not know why. One couple I know of spent 10k trying to get such an order. How much did you pay? How exactly did you obtain the court order? How long did it take?

If they dont have an acceptable court order the father must sign & probably appear at the embassy.

Thank you everyone for your guidance. You've really clarified the K2 process.

And, thank you to Mountain Climber and Ning as well. I now see that I've got some additional things I need to prepare as well.

MC is the only case I know of where a court order was used succesfully. I hope the questions I posted will be answered so others can understand how it was done.
