K1 VISA - When I am granted with the visa, can I fly back, restrictions!!

Timeline

Hi,

Very quick question.

We have a K1 visa that is being processed, this was recieved on the 22nd February. We are hopeful this is granted anywehre between September and October. I want to know, can I fly back for a family wedding mid December, and are there any restrictions ??

No traveling outside the usa until you have the AP approval or green card.

Timeline

You will have to file for an "Advance Parole" in order have the authorization to leave the territory and come back. It takes about 2-3 months to have it. People usually file for it at the same time as EAD and AOS.

If you leave the US without that document or a green card, you'll be good to file for a spousal visa to come back (if married before leaving). Not a good idea. :)

Your timeframe is pretty tight. Supposing you get the K-1 visa during Sept-Oct, fly as soon as you have it, get married as soon as you arrive, and file for AOS and AP as soon as you're married. Then pray to have your AP before mid-december!

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...

the k1 visa is for 1 entry allow u to stay for 90 days in the country and marry the US citizen during the 90 after marriage u file for the adjustment of status to get the green card this process takes between 3 to 6 months after getting the green card u can travel. if u travelled before getting the green card u are not allowed to come back to the U.S on the same visa cuz its for one entry as i said. u ll have to get a new visa to come back again

To give you an idea of current processing times for the advance parole, I sent my AOS, EAD and AP applications at the end of December 2011 and received the AP and EAD 2 weeks back. Maybe you will get yours a bit faster as each case can be different but that was my experience....like the others have said leaving the U.S without A.P or even better a green card will be a massive ball ache for you when you try to re-enter.

My guess is you won't have an AP travel authorization by mid December unless timelines shift dramatically for NOA2, London interviews, and Advance Parole. So you should decide what's most important--attending the family wedding or getting to the US asap to attend your own wedding.

If you get a visa in October, you don't have to use it for 6 months. You can remain in the UK until after the family wedding. Have your fiance fly over and attend with you. Then both of you fly back to the US together. Bonus: if she packs lightly, you can use her luggage allotment to bring more of your stuff over. Bonus2: The stress of timelines will be off your shoulders.
