Visa Turned Down in India due to "(in)sufficient economic and social ties to assure their departure after a limited stay in the United States"

Forget about using Visas to get someone into the U.S. for a second, and think about all the suggestions to marry. They're young, they have no money; can they even pay for a wedding license? By the sounds of it, they only spent a short time together. Whoever takes the microscope to her case will also see her previously denied visa.

Here's an idea for OP and his girlfriend: Why doesn't she go to Europe to study somewhere? Then OP can go visit her, spend some time together and really figure out what they want to do. Marriage is a huge step, and it infuriates me to see it get tossed around as some post-script solution for someone to go to school in the U.S.

Because going to Europe won't allow her to 'change her mind' (or the OP to change his), get married and camp out in the US waiting for AOS and a green card....oops....sorry....there I go again....giving a factual answer.

To the OP(to clarify my earlier statement about making some of our immigrationn laws more strict)...I would propose a few changes that would not cost the American taxpayer a penny!!!!!

1- disallow ALL changes of status from B2 (or B1) visas...arrive as a tourist, leave as one...(no more 'mind changing')....

2- arrive as a student, one MUST return to one's home country for TWO YEARS WITHOUT EXCEPTION in order to give one's native country the benefit of all those English lessons (or physics, or whatever)

3- No more autopilot six month admissions as a tourist...make it 3 and force the arriving 'tourist' to fully explain (with a straight face) the reasons he/she 'must' remain in the US for six months -- especially focused on the 18-50 age group (working age)

4- Overstay by one day, you are barred for one year no matter what

5- Overstay by two days, you are barred for two years, no matter what...etc...(unless you can prove you were in a coma)

6- Eliminate ALL waivers for overstays, misrepresentation, etc.

Now, for those 'honest' folks out there, these changes would not affect you...so why complain and start to whine about why our laws are so onerous? If you truly intend to obey them, why does it matter?

If you miraculously fall in love 9 minutes after baggage claim, you MUST return to the home country and WAIT for your immigrant visa...(after all, if this really is true love, why will it falter by being separted for a few months??)

None of these changes would cost American taxpayers a cent....and our airlines would benefit since people would wind up buying AND using round trip tickets...more than once!

In essence, this plan is 'forced responsibility.' if you claim you have no intentions to do something other than what you said, why should it matter?

This sounds good to me

No more AOS from the tourist visa and maybe MY spouse could have had the pleasure of visiting me during our visa process...there would be no option to immigrate--he would have to return.

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

I talk to her in Hindi most of the time because I often have trouble understanding the things she says to me in English.

Yeah, that could be another reason for denial. If your girlfriend can speak barely passable Indian English (that even you, her boyfriend, have trouble understanding) then the COs would have a hard time believing that this girl would do well in an American college/uni setting.

I came to the US in 2005 on a F-1, I interviewed in Calcutta. The only two things they care about:

1) You will return to India after your studies are over.

2) You have enough finance to cover your studies.

And as for my suggested changes, the net effect might well be to give more people the opportunity to visit/study in the US, knowing they cannot fudge the truth without severe consequences....part of the problem today is that the odds of somebody getting a severe penalty for having 'changed their mind' or whatever is relatively low....I suggest making it relatively certain.

I can easily imagine that should these suggestions be passed into law, we would also see far fewer spurious marriages when some visa violater is ordered deported and runs out the courthouse doors to find somebody to marry quickly, then plead for cancellation of removal....better to remove them and let them figure it out from a distance.

OK - You had never clearly mentioned what your status was so now its been established your are USC.

If you are serious about marrying you can file for K1 or go to India get married and file for CR1.

As mentioned getting a visa for ESL classes from India would be really difficult. Most students coming from India normally come for higher education.

Quite strange, someone wanting to fly all the way to the US of A to take up ESL classes, when there are specialized language programs right here in India. Errrr, what are we missing here???

Errr, remember you mentioning earlier that you speak to your girlfriend in Hindi! If you're a "white" ("goraa") American dude who went to India on an exchange program, where did you learn that Hindi from? And you still claim her English is good but that you can't understand it? Sorry pal, your story doesn't really hold up here.

Guys he is just wanting to fraud the immigration process.. we don't need to waste our energy on people who could care less about this country and its laws... I rather have him kicked out from here... I immigrated here as well but i hate people who start bad mouthing the any country they immigrate to when they don't like just 1 thing about it but don't want to return to their home country either..

He is trying to commit immigration fraud.. ITS BLATANTLY CLEAR. I had a friend from india back in australia who could speak better english than me and he just got off the plane when i met him... so i don't think his GF want to improve her english reason works...

I am sure he won't be back on this tread either as he could see people know his real motives..

I used to live in Peru. That's how I met my wife. As much as I love Peru, the country has a pretty significant problem with corruption. I dislike the fact that the National Police do almost nothing to protect the population until they receive a bribe. Also, I dislike the fact that beating women is, to a large extent, socially acceptable behavior in Peru. The capital also has a pretty significant pollution problem.

So now I've "bad mouthed" not "just 1 thing" about the country I lived in, but three things. I guess I'm one of the people you now "hate." I can live with that.

Good on ya then.. but i said about the country you immigrate to and you immigrated to usa not peru... paying more attention while reading might help you in life...

And you proved me right by not living in peru and coming back to america... i would hate you if you lived in peru and still complained about it which you have an option to go back to america.

I was born and raised in the United States. I moved to Peru. So you post about me, based wholly on conjecture, is incorrect.

I dislike corruption, and I find the physical assault of women to be intolerable. Like most Peruvians, I am concerned about the level of pollution in Lima.

Glad you hate me for that, though! Whatever floats your boat/helps you sleep at night is a-ok to me!
