Hello to all...We just filed our I-129 F petition and I am making some research about affidavit of support. My fiance is self employed so what do I need to present in the embassy? any advice?? thanks

They will need to fill out an I-134 and provide tax transcripts to prove their income. The line they look at for self-employed is line 22 of the 1040. They need to have at least 125% of the poverty level for their household size plus you: http://www.uscis.gov/files/form/i-864p.pdf

what about 1099?he already filed his ITR this year..is that enough?

You should get tax transcripts from the IRS, which you can order for free online. If you get those, you won't need to submit 1099s for the affidavit of support for the K-1 (I-134) or the adjustment of status (I-864) later on. If you just send them a photocopy of your tax return, you also have to send in the 1099s for the I-864.

The most recent year of tax transcripts is enough if it shows enough income, but you can submit up to three years if it helps to show sufficient income (such as if his income varies year to year slightly).

You are being confused now. You stated he is self-employed. Line 22 of the 1040 is what they look for when someone is self-employed. Do a search here for self-employed affidavit of support, if you believe I have stated something incorrect to you. You will find the same answer in previous threads here on VJ. You also said you just filed the I-129F. You have plenty of time to be able to get the IRS transcript. They are free.

Just gross.

It is not the same for someone that is self-employed. They look at line 22 of the 1040 in those cases.

I am self employed as well and if this is true I am in trouble, my adjusted income is very low, under 7k. I make 48k gross but my house payments, taxes ect take a big chunk. I do have 50k in savings will this get me by?

Please help, I am know very worried since I do not know if I can find a co sponcer.

They do not care about what bills you owe. Line 22 of the 1040 is your total income. Adjusted income is line 37. I suppose it would have helped to mention that above. That will teach me for posting while sleepy. For self-employed that is what they look at for meeting the 125% poverty level for your household size, your tax transcripts and not your bills or mortgage payments.
