This site states you can use an non-expired I-94 (some states only give a temporary license based on the I-94. You will need to ask about it at the GA DDS), EAD or green card : http://www.dds.ga.gov/drivers/DLdata.aspx?con=1741471757&ty=dl

Legal Presence Requirements: Present one of the following immigration documents in person at a Customer Service Center to prove legal presence in the US (only originals or certified copies accepted):

Valid (not expired) foreign passport with I-94 card or stamp or I-551 stamp

Permanent resident alien card (I-551)

Employment Authorization Card (I-766)

Reentry Permit (I-327)

For Refugees/Asylees: I-94 only (no passport required), or Refugee Travel Document (I-571)

For F-1, F-2, J-1, J-2 status – I-94 with valid foreign passport AND I-20 (F-1/F-2) or DS-2019 (J-1/J-2).

For customers from Visa I-94 waiver countries: Valid foreign passport with Visa I-94 Waiver stamp

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You will need to have your SSN, a valid immigration document , proof of residency (generally a lease or a bank or utility statement mailed to your Georgia address) and you will have to go in person to re-do all of the necessary tests - eye exam, written exam and in-car driving exam. The tests are given on a computer at the Department of Driver Services offices. http://www.dds.ga.gov/

Any license will be issued only until the expiry date of any immigration document, so if you have an I-94 for a K-1 it is for 90 days. It will take you probably 2 weeks before you get your SSN, and then you will need to arrange for proof of residency. When you go to apply for your DL, DDS will check with immigration to verify your status in the US. This can take several days up to several weeks. If you are near the end of your I-94 they may not issue you a DL until you can provide another proof of immigrant status with a longer date of validity - usually the EAD.

You should read over the Department of Driver Services website and study the Driver's guide, especially the rules of the road, even if they don't apply to your situation. The one question I missed on my exam was the one about how soon citizens moving from another state need to change their license to a Georgia license. I knew how long it was for an out of country driver, but missed the in country question.

You will also have to bring your DL from your home country with you and show it to them for identification purposes, They will give it back to you (they didn't when I got my license - they kept them and I don't know if they returned it to Canada or destroyed it. I just didn't get it back).
