My wife and I are waiting on the K-3 or I-130 which ever comes first but its looking like we wont be together by christmas.

I really want to spent time with me wife and new 4 month old daughter.. is there anyway she can come over, like a vacation visa or something? I guess what im really asking is if the K-3/I-130 would cause problems with her applying for a visa to visit?

twood2k,

I can really empathize with your situation -- in general, the best bet is for you to go out to see your family.

Regards,

KP

She is in Ukraine and our Daughter will have a U.S passport in 3 days (did application for birth abraod).

Hey Tom, I am sure you miss Angela and your little princess a lot! Good luck and I hope you can be together for Christmas, it just might be Christmas in Kherson.

YMMV

It is probably unlikely that your wife would be given a tourist visa with daughter in tow, it would be difficult for her to show ties to home country, and as I understand it, getting a tourist visa in that area of the world is difficult at the best of times. You'll have to go to the Ukraine to visit them.

Your daughter is 4 months old and is only getting her passport now? How long does it take?

The reason you are asking is I'm due in mid April and if all goes well I should have my visa around then....

It would kill me to wait another 4 months. :(

The baby must be present at the interview so we had to wait until she was old enough to travel by train from south Ukraine to Kiev (north uraine).

We also had some trouble with the birth certificate that required an extra trip for me and that ate up allot of time...

It only took or takes around six days to get the passport in Ukraine after the interview.

It is unlikely...but not impossible for your wife to get a tourist visa.. There have been instances where someone who has a spouse who applied for a k-1 , k-3, or I-130 etc ....and was still able to convince the consulate or embassy and be issued a tourist visa. (I read of one case in the Russia forum...in the regional section). And I have heard of people who have applied for an I-130 and still be able to get a tourist visa.

But the fact is...it will be tougher on you and your spouse to convince them because of the pending AOS application. Also , the other difficult factor is that you have a child and want that child to come too. (The instances I know of, where people have been able to get a tourist visa, there was not a child involved).

I think the only thing you can do is personally contact the consulate. Just try your best to get hold of someone in authority there (like a consul general or deputy consul) and do what you can to convince them.

More difficult by phone......but I don't think you have much choice since you obviously can't go there in person.
