You petition to remove conditions 21 months after your US arrival date.

I found this on official website "You should apply during the

90 days before your second anniversary as a

conditional resident. " sorry for being so naive does this mean 2nd weddinv anniversary or aonething else?

No, it means 90 days before the 2nd anniversary of you arriving in the US. Your wedding anniversary will have no bearing on this. For example, I was married in August 2010... My husband arrived in the US sept 2011. We will apply for ROC June 2013, which will be 90 days before the 2 year anniversary of his arrival in the US.

Hi guys,

Would you guys please advice me on my situation:

- Married to my wife who is a US citizen on 07/07/2011 in Florida (I was on F1 Status)

- I got a very good financial job in Beijing so I went back home in the end of 03/2012.

- My wife went back with me for 2 months then came back to the States after realizing that she's pregnant and we both know being in the States with the family is better for her and our baby

- I worked in Beijing for 8 months then came back to Florida end of 11/2012 with a B1 Visa.

- Filed for AOS in 01/2013 and got my fingerprints done on 02/25/2013

My question is if everything went smoothly with my AOS interview, would I still be granted a 2 year green card with a condition? If so then should I file for Condition Removal 90 days before our 2nd anniversary which is 07/07/2013 or the 22 months start again from 11/2012 ?

Please disregard the complexity of my timeline. I would appreciate your advices very much.

Thanks again for your time and I look forward to seeing your comments.

Assuming your AOS interview is before 07/07/2013 (which is likely), you will get a 2-year green card, and you'll have to file for removal of conditions between 21 and 24 months after your green card is granted - i.e. some time in 2015.

Spouse-based AOS from out-of-status H-1B, May - Aug 2012

Removal of conditions, Aug - Nov 2014

You will get a 2 years conditional GC, if your AOS is approved before 7/7/2013. Then you can to file I-751, 90 days before the expiry of your Green Card (check the expiry date of the GC, after you receive).

However if your AOS drags beyond 7/7/2013, then you will get a 10 yrs GC, as you would have completed 2 years of marraige as on the date of your AOS approval.

you don't want yer Green Card Expiration Date to be 7/7/2013.

You want the green card ISSUANCE date to be after 7/7/2013.
