Hi, my fiance had his oath as a USC just this feb 2012, and soon filed a fiance visa petition for me maybe a week after. We already received the NOA1 and are waiting for the NOA2. This stage is killing me! I really hate waiting, and Im gettin more and more nervous about it everyday.

Our case is a bit complicated. You know, my fiance and I had been together even before he and his ex got divorced. We met in June 2005, and became friends. DUring that time, he and his ex were already separated but I guess they were still trying to work things out. Then, he went to the US in Dec 2006, and both of us were still good friends. When he was in the states, he and his ex both agreed that its much better if they will get separated for good, and will file a divorce as soon as they can. He went again to the Philippines in 2007, we met again and got attracted w/ each other ( I guess he really liked me even before! LOL) and right then we started dating and we officially became a couple just before he left again for the states w/c is a month later. Since then, we started sending emails, do chat and call each other on a regular basis. His ex filed the divorce in 2008 and after signing the paper works, he visited me and stayed here w/ me for like 7 months and left again for the US.. Then he visited me again in 2009, and 2011 which were both just a month-long visit. The divorce was granted last October 2011. And so we got engaged in January 2012. Fortunately, he became a USC just this feb and he filed the K1 a week after. Now I wonder if the consul will question our relationship because we've been together even before he got divorced. I mean, will it be a problem? I am so worried. Pls help. thanks.

All USCIS (and USEM) care about is that you are both FREE TO MARRY each other at the time of application. So as long as he has the final divorce decree BEFORE filing the petition there are no issues.

And of course the normal - meeting within the past two years...

Thank you, hank_amy.. yes he already had the final divorce decree before he filed for the K1. And about the meeting requirement ( w/in the past 2 years), we have just seen each other last year.. I hope everything will go smoothly..
