Timeline

So I have been living in Chile for the past 3 years and haven't filed taxes in the US for at least 2 or 3 years ( my mom was actually in charge of this and she just didn't know that she had to do it )- I am in the process of filing taxes this year, with my foreign income since I have realized that I technically have to do that ..

Does anyone know what I should do on the I-864 form?

Do I just not check mark where it says that I have filed taxes for the last three years?

Where it says : I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year.

The second sentence is true - but the would (or could be) true if I get my tax return done in time but first is not since I have not filed taxes for the past three years.

Is there anyway to just not fill out a I-864 form for myself and only have my joint sponsor fill it out with an explanation as to why I haven't filed taxes for the last 3 years ... I don't think I will even have a copy of my federal tax return by the time I petition the visa since I am just now filing my taxes..

Has anyone had a similar situation?

Check the box but attach an explaination of why you didn't file taxes for the previous years (date,case#,signed). Send your most recent return with all schedules/W2's. Send your paystubs/wage slips and any other proof of other income (if any). The joint sponsor should do the same but must make 125% of poverty guideline for total persons in household plus sponsored immigrant.

07/05/2011: DS-3032 email received

07/05/2011: DS-3032 emailed

07/06/2011: AOS Bill received

07/06/2011: AOS Fee Paid

07/09/2011: I864 Sent

07/11/2011: IV Fee Bill received

08/30/2011: IV Fee Paid

09/30/2011: IV Pkg Sent

10/24/2011: RFE (we dragged our feet from here on)

(forget all this for now, let's go on holiday!)

03/13/2012: NVC CASE COMPLETE!!

04/05/2012: Received interview appt email

06/22/2012: Medical @ Knightsbridge

06/29/2012: Interview 8am-Result: Pending

??/??/????: I601 Filed at Lock-Box

You should figure out if you were required to file those taxes, and if you were you should go ahead and file them. Now that you know they were never filed, why not take the option that is least likely to get you in trouble?
