Hi Everyone! my name is Daniel, i'm a 28 years old guy from Argentina

My girlfriend is just 18 (us citizen), we met when she was 15, on the internet(because i sold her something online) and we became friends, then we met in NYC when she was 16(with her mum), and now after 2 years, we're in love and we want to be together.

We're planning to start the k1 process at the end of this year, but i'm a bit scared, because our age difference is HUGE, she is 18 and i'll be 29 soon...and i'm scared the officers would think i'm doing it to get immigration benefits. Also it's a bit weird that a 18 years old girl wants to get married, most girls that age just wants to party and get drunk.

Oh, and another thing, i applied for the DV lottery few times...

Her parents supports the relationship, her mother loves me, and in fact they're going to be the joint sponsors for the affidavit of support because my girlfriend will go to University and won't work.

Do you think the immigration officers are gonna supect of our relationship because of our age difference, and also because i applied for the DV lottery?

Thanks!!

Dan

For the petition it makes no difference, she is "free to marry". For the visa issuance the age difference and her age itself will not be a problem in itself. Applying for the DV lottery is not a problem in itself. As for other factors in your case...they are what they are, you cannot change them. Simply provide plenty of evidence that your relationship is NOT for immigration benefits and hope for the best. No one here can say "oh yeah, don't worry"

should we just say that we met now to make things easier? i know that would be lying, but i don't want that our application gets denied :S

You risk yourself to a life-time ban to enter the USA... Never ever lie to a CO

Lying will never make things easier. What is easier is describing exactly how you met and showing evidence of an ongoing relationship which is not based on immigration benefits, ALL of us have to do it/ had to do it. You will have to do it several times during the process, the visa is just the first time, not the last time. NONE of us can guarantee you that "everything is OK" and anyone who suggests that simply does not know what they are saying. None of us know the details of your case or have seen any evidence, and nothing you could type here would change that.

You will have the opportunity to present evidence to the consulate that you have a legitimate relationship. I suggest to you, and anyone, that you do a good job of it. You cannot change the circumstances of your relationship, it is what it is. You CAN make the best of it and that does NOT include lying.

A couple in the DR was denied because of this same rfeason, when the relationship started the wife was an under-age individual. I am more concern because you started a relationship over the internet with an under-age child. This is a BIG REd Flag.

I totally agree. I also remember that case BTW.

A teen girl having a friendship over the internet with a grown man is a HUGE red flag not only for Immigration purposes but it's just not wright. As a matter of fact we as parents are constantly told that we must be checking who are our teens socializing in internet. I certainly would not allow my teen daughter to socialize with a grown man. So, bottom line you more likely will have to explain this in your interview. Be prepared to answer the question of how you both first met and Do Not lie.

True. I emphasize again that you absolutely MUST, IN ADVANCE, quell any suspicion of an illicit relationship with a minor. This means including what I recommended (above) in the petition package, regardless of whether USCIS cares about it or not. The consul has 100% power in this instance, and heading off suspicion ahead of the interview should be your chief goal.

They don't say "16 will get you 20" for nothing. Along with providing evidence of a bona fide relationship, take away the possibility that the consul may use the "underage" angle to refuse the visa or get "in your face."

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

if the last date you saw her in person, face to face, is over 2 years from TODAY, and she's not filed the I-129F petition yet,

then another trip is necessary, before filing the I-129F.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Can you pass for 18 or 19 years of age. Do you hang out with any in that age group in Argentine? Just prepare your self, watch MTV. Good luck and enjoy.

OK, how did it work? It sounds like to me you sold her some merchandise online. During the process you exchanged a few emails to make the deal work, and since had communications with her and her mother. Since they were nice enough and you always wanted to travel NY anyway, your new friends, her and her mother, offered to show you around while you were in town. Your friendship and communications with the family continued until recently where you became more interested in her after she matured into an adult. This is how i read your original post. Sounded innocent enough. Better the truth than a lie.

Hmm...I (the petitioner) am 19, and my fiance is turning 19 in 1 month. We met online when we were 16. Will this be a problem? Sorry for asking in your thread, OP! but your question made me have doubts. I hope they don't look at us as too young. Does "underage" even count if we are both the same age?
