hi everybody it been 2 month sinc we appeal the revoked i130 petition but we did not hear nothing yet and my wife think to reply again but we dont know if its better to stay fighting on the appeal or reply again

so i need some advice to see what is the best for us

reply or stay waiting on the appeal thank you

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Refiling is an exercise in futility, USCIS would see the revoked petition and deny a refiled petition on the basis of the revoked petition. Your only viable path is the appeals process.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

can we apply for k3 visa and waiting for the case in usa because my wife is sick and she need her doctor and she dont want leave me because we love each other and she want go to consulat and talke with them and if they did not found solution she want stay outsid consulat tilll they give me visa

No, K3 visa is obsolete, in fact applying for same could slow down your case.

If your wife is very sick, she can apply to expedite the case with supporting evidence (doctors letters etc).

So you not understand the answer - instead, you should give the answer to YOUR WIFE, as it's on HER, ultimately, to handle all (not you)

IMO, there's been a procedural error at USCIS. It's on your WIFE to bring this to the attention of USCIS, so that the case can go forward. Otherwise? the casefile will die, no further action.

sounds to me like the evidence submitted never, ever made it to the right desk on time.

Call into USCIS, get an ISO, a Tier 2 Human,

and inquire about what they received, and when they received it.

Then ask if the case was revoked based on a review of the submitted documents, or if the case was revoked because the documents were not reviewed.

'Document review' here makes a world of difference - they can't review what they don't have.

Usually, 'the man on the phone' is a CSR, a Tier 1 Human, and cannot see details about your casefile on the computer. A Tier 2 Human™ has higher computer access, can see all.

Now, you really need to get yer USCitizen Spouse to do this (not the foreign spouse).

The U.S. citizen ( I presume your wife) needs to contact her Senator or Congressman in the state she lives in for assistance on finding the status of your petition IF she will not call USCIS herself. Those are your 2 options on finding out what is going on with your case. Other wise waiting is your only other option.......

Me and my wife went to doctor today and last week but today he told us that my wife have a tumor in her neck and she need surgery but the problem is she don’t want leave me and she sent message to congress man and embassy here and they sent message back and embassy called us today but she told them im not leaving my husband even if i die and i did told her to go back to usa and get surgery but she said we will go soon i will expedite the appeal of medical reason and everything will be okay and im lost I don’t know what to do I don’t want to lose my wife because of this stupide process visa
