k1 and greencard lottery

Hello,

I have a question. I applied one month ago for the k1 visa and now i am thinking to apply also for the greencard lottery, since i think the greencard would come later but the procedure be easier. I am assuming though that i would be already in the states (in case i win) will be notified (but my mom will pick up my mail), but would it acutally help if i win the greencard? can i even participate or is it illegal?

It's interesting that you would ask this question. I don't know all of the answers to your questions, but I will say that my fiance is planning to do the same. Based on what I have read one does not affect the other. It is definitely not illegal, but the only thing to remember is that in order to be issued the K-1 visa you need to be in your country for the interview. Once you get to the US you should be able to at some point file for an AOS based on winning the visa lottery (if you win). But I must admit that I do not know all of the intricacies involved.

Hopefully others with more knowledge will chime in.

hey.... I am not a 100% certain about this, but this is what I think, while it is not ilegal to apply for both I decided not to do it since you never know, they might get suspicious and think that you are only getting married for the visa, but that is just my own personal thought. On the other hand I was here in the States on the k-1 visa long before the results from the lottery were anounced and I will get my greencard before this next lottery comes trhough... so.... I don't know, since I one had the same question and this is how it worked out then I figured it wouldn't have made sense to do the lottery anyways, it would have taken longer for me to get here if I would've won it, on teh other hand it will be a greencard that will not depend on your marriage, but I just think it is unecessary, not bad, not ilegal and it is an easy process to just apply for it, but I do know that even when you win it takes a while to get the GC and be in the US... so... all these are just my own personal thoughts, hope they help.

what i think now is that the earliest to move with the greencard in the lottery would be janary 2008. hopefully i will be in the states already then. but after the k1 the greencard is only temporary, righ? and the one in the lottery is a "Normal" one. or am i wrong? could i even take advantage of the lottery greencard after being issued the other one?

The Greencard you get after doing K1/AOS is a normal Greencard.... it does have conditions that have to be removed 2 years after it was issued.... but you have all the same rights as any other Greencard holder....

I do have to ask "what is more important to you? Being with your loved one as soon as you can OR getting that Greencard????

god, i hate these questions. off course i want to be with my fiancee. if you would read my posts carefully you would see that i asked IF IT IS POSSIBLE TO CHANGE GREENCARDS WHILE I AM ALREADY THERE WITH THE K1 GREENCARD. Never mind, I know there are a lot of people out there who just get married to get to the States and that makes me upset too... But i am not one of them. So if the Greendcards are the same, and the conditions are the same, i do not need to apply.

That was exactly my case. I got the K1 visa and a few days later (before entering the USA) I received my selection letter for DV 2007. I went on with the lottery process and then entered the USA with my K1 visa.

Now I got my K1 based GC and haven't heard of the DV lottery yet.

If you get picked at this year's lottery, your lottery-based GC will be for 2008. By that time, you'll already have a marriage-based GC. K1 is definitely faster. Believe me, that was my case.

thanks kweli. i saw you received a packet 4 in your k1 process. what is in there? i thought there is only a packet 3....

In my packet 4 there was Interview date notification, List of doctors for medical exam and fee payement instructions. That's about it....

If I may give you my opinion, just go on with your K1. It faster and you get citizenship after 3 years Vs 5 years for DV lottery.
