Just got my rejected packet in the mail today. The rejection notice says, "This is in reference to the N400, Application for Naturalization, you submitted. Your N400 is being return to you for the following reasons:

Part 2 of the N400, Application for Naturalization, Information about your eligibility, shows that you are seeking naturalization based on either:

A. Section 316 (a)- been a lawful permanent resident for 5 years or

B. Section 319 (a)- been a lawful permanent resident for at least 3 years and have been married to a USC for those 3 years."

Now my question is, does any of you April filers came to the US via K1?

I also came on K1 and I accidentally filed 2 days early. The notice date on the NOA1 is the start of my 90 day window.

Maybe it is related to the mix-up she had during AOS when they sent her the 10 year GC instead of 2 year?

You should still be able to apply for your citizenship as you have been married to a US citizen for all of those 3 years since you became a PR (assuming that you are still married to your US citizen spouse).

@Frali: I read the guide to naturalization again at the USCIS website and it did say there that I am eligible to apply if I've been a permanent resident for 3 years AND married to an USC for 3 years or more. Knowing that I came to the US via K1, I'm thinking that the USCIS doesn't recognize the conditional 2 years as continuous residence.

Anybody that came to the US via K1 and now applying for naturalization? I'm thinking of canceling my INFOPASS appointment. There's no sense of driving 1 1/2 hr to Philly for something that I'm not eligible for. As you can see down on my about me page, I came to the US on 2009 and married my husband the same year. I was granted PR status last year.

I came on K-1, got married at almost the same time as you. We just did ROC in the same month, with frali too. Did you include a copy of your marriage certificate with your application?

My wife and I utilized the K-1 visa. Our time line is pretty darn close to yours. Married 2/2009, AoS Greencard 7/2009, RoC Greencard 2/2012. You are actually a few months ahead of us on the 10 yr GC. We filed the N400 on 4/27 and received the NOA already. Might just be simple date miscalculation on their part.

I think it may be a date mix up because according to what you wrote you are well in the window to apply. I would go to the INFOPASS appointment and ask them what went wrong.

When we go online to check hubby's case status from our laptop, iPhone & iPad it doesn't work ... Anyone else tried it tonight to see if it comes up error MSG with USCIS website ???

Never mind... On the top right side of USCIS website it sas case status will be unavailable from 9pm to midnight on 5/10

@Dagobert: My GC says that I'm a residence since 6/29/09.

Could this be the reason why?

I'm so glad that all K1 filers replied. I am hoping for everything to be squared out on the coming INFOPASS appointment.
