Good morning VJ,

My wife's CR-1 visa is approved. And now we're thinking of finding a job for her to pay back to Uncle Sam.

Since it's a CR-1 visa (which will grant her a 2-year conditional permanent resident status), will she need to file USCIS I-765 Application for Employment Authorization before she could work full time?

Any help would greatly appreciated.

Doing research right now would be a good idea. The 765 has nothing to do with CR-1 visa holders at all.

She gets a green card on entry to the USA.

She will not need to file for employment authorization. On the DS-230 was the box for requesting a Social Security number checked? If so one should be issued a few weeks after point of entry. Otherwise you can go to your local social security office and request a SSN once she arrives in the US.

07/28/11 - NOA1 for both

02/21/12 - RFE for both (received hardcopy on 2/25)

02/28/12 - Responded to RFE for both(received by CSC on 2/29)

03/02/12 - NOA2 for both(received hardcopy on 3/8)

NVC: (37 days)

03/12/12 - NVC Received both

03/21/12 - NVC case number and IIN received for both & Emailed Choice of Agent for both

03/23/12 - AOS bill invoiced & paid for both

03/26/12 - AOS bill shows paid & AOS Packets mailed for both

03/27/12 - Choice of Agent accepted for wife (sent another for step-daughter via email and express mail)

Not at all.

The I-765 is only for beneficiaries adjusting their status to LPR status.

With the 2 yea conditional green card, she already is an LPR, and can work, travel, go to school etc. as she pleases. No restrictions unless US citizenship is required for the job. Other than the removal of conditions in 2 years, you are now done with immigration. Congrats!

No. Your wife does not need to file for an EAD.

Once your wife enters the US on her CR-1 visa, her visa becomes a temporary conditional green card (I-551). She will get the plastic I-551 (green card) a few week after that. The I-551 is her employment authorization.

All your wife needs to be legally employed are her green card and her social security card.

Even if your wife checked to request a SSN on the DS-230, she should go and apply at the local SSA. Vietnamese have a very limited pool of names; there are only about a dozen last names that covers 90% of the population. My Vietnamese name brings up another 12 guys in Southern California alone. The SSA will not issue a new number if they find similar names in their database.

My brother and his family requested SSN on their DS-230s. The SSA would not issue them SSN until we went into the local SSA office and prove that we weren't people who already had numbers who were fraudulently seeking additional numbers.

Employment authorization required?

No. however, to legally work in the USA, she needs an SSN. Study the I-9 form, todayish.
