Can we get married when I'm visiting my fiance on a visa waiver program ?

Sure you can marry as long as both of you are free to marry in jurisdiction you intend to marry.

In other words, if you're able to get the marriage license from local jurisdiction then you can.

There is no immigration specific question here, right?

You can marry, but you have to return home after the marriage has taken place. Coming to the US under the VWP with the intent to not only marry, but remain to adjust status, is visa fraud. The marriage part by itself is no problem whatsoever.

You can file for the CR-1 spousal visa right after you are married. You'll have to wait out the process back home, which will take around 9-10 months to complete I believe. There's a very detailed guide for the CR-1 process here on VJ, under "Guides".

Yes, you may travel to the US and marry, however you must leave when your authorized stay is finished.

You may also file for the spousal visa while you are still in the US - the interview and medical will happen in your home country
