Received Request for Evidence

Hello all,

I recently sent my I-130 packet out last month. I received a request for evidence notice a few weeks later wanting some documents in their original languages (which I already sent yesterday). Strangely here in Egypt, DHL, UPS, or FedEx would not ship to the PO Box number they gave at the bottom of the blue page. I had to call USCIS and they gave me a full address to send the documents to. I would like to know if this is any good sign they are processing our application? It's just been a month but I hurried and sent the requested info back. I am not planning on hearing any answer yet as I know it takes time but just curious if at least it's being processed.

Thanks for any advice.

Jenny

Did you receive any I-797C also known as NOA1 after filing your petition? If you did and this request for evidence came in after that then yes it is a good thing.

Are you the petitioner and are you living abroad with your spouse? If yes than that might be the reason your petition is receiving prompt attention.

Was it a 3 or 4 page RFE or just a simple RFE?

If it was a 3 page RFE then I have seen those take months to get NOA2 and some are still waiting now since Jan for NOA2. They sent the rfe back to uscis in Jan. There are 3 egyptians that have had this 4 page RFE since last year.

Here are their names

1.mosha1972 (Mohamed & Lisa) 5/23/11-Got RFE 11/17/11 dont know when they sent it back

2.ÒæÌ & äæÑÇ (why not1) 6/2/11-RFE sent back 1/17/12

3.Angel Eyes Yuseef (hubby and nora) 6/2/11-RFE sent back 1/20/12

May 24, 2011 NOA1

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

PLEASE EDIT YOUR TIMELINE IN YOUR PROFILE SO OTHERS CAN LEARN HOW LONG EACH STEP TAKES IN THIS PROCESS

It could very well be because you are living abroad with your SO. Since they did away with direct consulate filing, it's possible they are pushing your application through at a much faster rate.

Good luck with your journey and let us know if you do get your NOA2 any quicker!

since you just sent out the RFE response yesterday,

you still have no casefile status, but since an RFE was sent to you, an adjudicator had looked at it, in an attempt to approve it.

So, wait a bit, about 2 weeks to 3 weeks after yer shipping company states it's been delivered,

and you'll know something more about the approval.

you have a good calling plan into the USA? google voice? skype ?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

DHL, UPS and FedEx will not ship to a US PO Box regardless of what country you are shipping from. Post Office Boxes are managed by the United States Postal Service.

Thanks again for all your replies. I didn't know that about UPS, FedEx, etc. (interesting!). As for a calling plan, what do you mean? :)

And what is an NOA2? Notice of Action 2 means approval of the I-130? UPS is supposed to deliver it today from what they told me. Will

they send us any confirmation of the case because I had included my email and phone no (for the application status) or can you just

check online?

Thanks again!

Yes, NOA stands for notice of action. NOA2 refers to the approval notice you will receive approving the I-130. NOA1 refers to the letter you receive letting you know that the I-130 was accepted. The RFE (request for evidence) you received means that an adjudicator reviewed your application, but that he was unable to approve it because of the missing documents.

I would really suggest reading the guides you can find on this website--they will let you know what to expect out of each step of the process, and help you avoid the mistakes that may have led to your getting the RFE. (In other words, if your application had been complete when filed, it may have already been approved.) You should look now at the next step of the process (NVC) and start collecting information and documents you will need. The guides will help.

Oh my.

a calling plan ;) something that you are using with a telephone or voip device so that your telephone calls into the USCIS call center not cost you more than 2 cents/minute from where you are. Having a calling plan is important, when you live overseas and have gotten a RFE during a fast adjudication process.

as to delivery address for USCIS lockbox in Chicago - there are two -

one is a PO Box, for USPS postal delivery,

and another for Courier Intake (DHL, Fedex, UPS, EMS)

NOA-2 is VJ jargon, USCIS not know of it - it's the approval notice on the I-130, sent on a I-797-C formletter from USCIS.

UPS is delivering the RFE packet today. Cool. In about 3.5 weeks, you'll know more status on yer casefile at USCIS.

re: confirmation of the case - well, if you include the G-1145 with the I-130, you'll get something electronically, maybe. Instead - you can absolutely check online - have you been checking yer casefile status online? do you know how to do?

IMO - you should read -> http://www.visajourney.com/wiki/index.php/EZGuideSpouse

and refactor your plan, a bit.

Good Luck !

Hi,

Thanks a lot for the info. How do I check online? I do have my case no on the RFE sent to me. I did send in a G-1145 with my email and mobile no. I never really

thought about calling by Skype or Google Voice. I will check into that! I am living in Egypt with my husband and we don't have DFC - I filed with Chicago lockbox. I checked the guide you gave me but it just mentions DFC. Is there another guide for my situation? Thanks!

Your petition reached an adjudicator's desk so fast only means that it was categorized as DCF. Maybe you had put your Egypt address on your I-130.

You may check your case status at www.uscis.gov

There is a column on left side of page with link to check your status online. You can either sign up there to receive updates and add your case to your account portfolio or simply key in your receipt number which starts with WAC.
