My wife and I (married 5 years on June 1st) have finally filed the I-130 and are currently waiting for the NOA1 to happen.

We do know that we will have to file the I-601 waiver when all is said and done.

What we would like to know if anyone on here filed one of these waivers from The Netherlands before (we searched and could not find any)?

If so, how long does it usually take? And what are the chances of being approved for one of these waivers if only needing one because of an overstay?

Ours needs a waiver because of an overstay that resulted in a ban of 10 years.

Waivers cannot be filed until ones case is determined to need one. This is done at the interview, not before

So no, you cannot file an I601 waiver for a case that has not been determined to need one (and no, you do not determine this)

I'm sorry, you'll just have to wait. If a waiver is needed then the visa will be denied at the interview

Hi Everyone,

I am the other half of the original poster here. First, I would like to thank everyone who has posted on this board and the other website. Tons of very useful information to be found on both. I have read just about everything I could possibly read on both sites off and on for years. There have been some cases that came close to ours but not totally. Everyone is unique and part of me is glad that we are. I don't suggest anyone on this planet ignore that overstay rule...ever. As far as the waiver goes, we did not file it with our I-130. Roy was of course denied a travel visa and they explained to him what we needed to do and we were informed of the 601. This officer also asked why he did not just file an AOS while here. Blew my mind when he told me that. Probably a good thing I was not there my eyes would have bugged out of my head. It is fraud to file an AOS while on a visitor visa. It was also wrong of me to be so selfish and keep my husband here for well over his time as well. But, we can not go back and undo it and can now only proceed with what we need to.

Anyway, we did read on the other website about the woman from the Netherlands who did file for the waiver. We just wanted to know if anyone had ever had to do the waiver for overstay (no criminal charges, deporting or anything like that for either of us) in the last year or so who is in the Netherlands? Roy and I are both just very anxious as anyone else starting out on this journey would be. Any and all advice for this long road is very welcome and so very appreciated.
