Fiance visa with a twist

Hi,

As the decsription says, what are our options (if any). She is brasilian and live there, I am french and currently live in the US with an L-1 visa. The idea being that we would like to get married so that she could come to live here with me when she is done with her study in about a year. As I have a L-1 visa, she would be entitled to L-2 visa but I wonder if it's possible to get her to come in the states this winter (she has a 2 months break) on a fiance visa, get married here (which might facilitate the next step process of applying for her L-2) and then apply for L-2 while she is back in brasil for her last semester.

What would be the best course of action?

Thanks

Ludo

There is no fiance visa for non citizens. If she can get a tourist visa, you can get married in the USA, you apply for the L2, she leaves at the end of her tourist visa stay and finishes the process in her home country.

Since you're not an USC, you are not eligible to petition for fiancee visa for her.

She can try to get B1 tourist visa if you want to marry in the US. Otherwise, you will have to travel to Brasil (or to some other country both of you can enter) to get married.
