my name is Mike..i have been a permanent resident for the 5 years now. i am trying to apply for US citizenship but i am worried. in 2009, i got a ticket for possession of marijuana (less than 1 ounce)..i live in Nebraska..so i was charge with the above crime as an Infraction (I)..the city attorney told me it's not a serious crime. i have done my community service. this is my first crime and i have never been to any other state. i am scared that i will get deny and probably be deported if i apply. i have never been arrested or sent to jail before...i got a ticket for fictitious license plate but i know its not a crime so i am not worry about that..i am just worry about the marijuana..i have been doing research about my crime (marijuana possession) and they said that if the possession of marijuana is less than 1 ounce it's not a big deal and i won't be turn down for US citizenship. but am just not sure..help please.thanks

I think that as long as you present all the court documents stating that you served the sentence and all the fees have been paid you should be OK. I don't think this is something people get deported for. However, you have to disclose EVERYTHING on your application, including the ticket for the license plate and ANY other ticket you ever received. If you have a speeding ticked, for example, you should list it on N-400, however, if it was less than $500 you don't need to present any documents that it has been paid.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

C) Controlled Substance Violations .

Per section 101(f)(3) of the Act and 8 CFR 316.10(b)(2)(iii) , an applicant who has violated any law of the United States, of any state within the United States, or of any foreign country relating to a controlled substance is precluded from establishing good moral character, unless the violation was for a single offense of simple possession of 30 grams or less of marijuana. See Chapter 74.2(g), question 12 parts (A) and (F ) for more details regarding these types of violations.

You need to report everything regarding all your convictions(even if the case had been closed or you have completed your community service) at the Oath ceremony. If at all the USCIS finds it out at a later stage, there are chances of your citizenship status getting revoked. 1oz = 28.3 grams.

The magic number here seems to be 30 grams (= 1.05oz) so if it was one offense of less than 1 oz, thereby less than 30 grams, I think you should be fine as long as you disclose it.

Don't worry about traffic tickets. Normal traffic tickets should be disclosed, but will not make you ineligible.

I would disclose, present all paperwork and hope for the best. Being here temporary and not a citizen takes extra precautions. Good Luck or see an immigration attorney for more legal answers.

The 30 grams or less is for a single, simple possession. If any of the records show anything more, e.g. intent to sell, etc., then all bets are off.

No lawyer ! i got more them 5 arrest and got convicted in a few of them i had my interview feb 29 brought all my court disposition for all my arrest to my interview ....now i'm just waiting for the outcome! last time got arrest it was 7 years ago! so just chill an smoke another bag of weed! Lol.. Thats nothing compare to my case!

do you guys think i should find an immigration lawyer for my criminal record when i am applying for citizenship?
