Hey guys,

We're heading for the next step, the filing of the I-864 to the NVC.

now, we will be filing with assets only, but i would like you guys to see if I'm not missing required docs. please keep in mind we're both living abroad and we cannot provide W2's, employment letters, etc.

I used the copy of the IRS filing instead of the tax transcripts as I don't have them available for the moment.

• Completed and signed I-864

• Copy of of IRS filing of 2010, form 1040 & form 2555-EZ (IRS tax transcripts are not available yet).

• Copy of of IRS filing of 2009, form 1040 & form 2555-EZ (IRS tax transcripts are not available yet).

• Copy of of IRS filing of 2008, form 1040 & form 2555-EZ (IRS tax transcripts are not available yet).

• Original House appraisal that shows fair market value and location + copy + translation

• Bank repayment plan of house 1 (mortgage)

• Bank repayment plan of house 2 (mortgage)

• Proof of ownership: Original property tax bill 2011 + copy + translation

• Print screen of bank accounts on 04/04/2012.

Will this do it or am I overseeing something? Do I need to do an I-864A (the instructions say 'possible' which is confusing :) )?

I heard it had to be over a certain amount, just make sure you dont need a co-sponser first. using assests can be confusing.

I'm not sure your tax bill proves ownership. Do you have the Deed?

Haven't seen anyone using 100% assets on the i-864 before. I don't think you need i-864A unless you use relatives' asset.

You don't have any prove of income in Belgium? What is Belgium's equivalent of W2? I would put more than required on the i-864.

It's not too bad since you only need $94,560 for household of 2.

We do have a deed, but that would cost me an arm and à leg to translate as it is very complicated and long.

I do have proof of Belgian income, but it won't continue in the States, so I didn't see the point of translating and filing it, as the assets should be sufficient. Is it worth

the cost?

The assets are in both our names (spouses), but all communication shows my name (beneficiary) on it. On the I-864, does it make a difference on which name they're stated?

I prefer not to cut it in half for the form, as they might have trouble to figure out where the numbers came from.

It doesn't matter whose name the assets are in, line item 28 allows the assets of the beneficiary to be included. Mike411's math appears to be correct that you'd only need $92,560 (1.25 [poverty line requirement] x 15,130 [2012 poverty line for family of 2] x 5 [assets valued at 1/5 actual value]), but the consular official could raise doubts about your ability to convert assets to cash "without undue harm." My guess is that this method will receive more scrutiny than using income, but will probably work, especially if you have more than one home.

The following quotations are from the I-864 instructions. Note that you don't need an I-864A:

How Can I Use Assets to Qualify?

Assets may supplement income if the consular or immigration officer is convinced that the monetary value of the asset could reasonably be made available to support the sponsored immigrant and converted to cash within one year without undue harm to the sponsor or his or her family members. You may not include an automobile unless you show that you own at least one working automobile that you have not included.

28. Assets of the Intending Immigrant.

You may use the assets of the intending immigrant regardless of where he or she resides. The intending immigrant must provide evidence of such assets with this form. Form I-864A is not required to document the intending immigrant's assets.

29. Total Value of Assets.

In order to qualify based on the value of your assets, the total value of your assets must equal at least five times the difference between your total household income and the current poverty guidelines for your household size. However, if you are a U.S. citizen and you are sponsoring your spouse or minor child, the total value of your assets must only be equal to at least three times the difference. If the intending immigrant is an alien orphan who will be adopted in the United States after the alien orphan acquires permanent residence, and who will, as a result, acquire citizenship under section 320 of the Act, the total value of your assets need only equal the difference.

Example of How to Use Assets: If you are petitioning for a parent and the poverty line for your household size is $22,062 and your current income is $18,062, the difference between your current income and the poverty line is $4,000. In order for assets to help you qualify, the combination of your assets, plus the assets of any household member who is signing Form I-864A, plus any available assets of the sponsored immigant, would have to equal five times this difference (5 x $4,000). In this case, you would meet the income requirements if the net value of the assets equaled at least $20,000.

ya, assets are fun .

for the USCitizen, it's pegged at 1/3 of the value, and for the Foreign Spouse, 1/5 of the value.

so, having a deed solely in the USCitizen's name, is useful.

Hey,

I am in the same situation as far as the form 1040 and 2555 (I don't have the transcript ready yet) and I don't have any W2. Was it sufficient for you?

May 16th 2012: I 485, I 765, I 131 send by USPS priority mail at the Chicago lockbox

May 18th 2012: AOS received and signed by D.Colonna at 2:18pm at Chicago

June 4th 2012: got my all package return, restarting from level zero again :((((

This paragraph of the instructions is also critical to understand. Foreign real estate is considered differently that liquid assets present in the USA or that will be transferred to the USA when the foreigner immigrates.

Assets may supplement income if the consular or immigration officer is convinced that the monetary value of the asset could reasonably be made available to support the sponsored immigrant and converted to cash within one year without undue harm to the sponsor or his or her family members.
