Visa I130 for husband

Timeline

Okay so ive never used a forum before so bear with me.

I'm an American citizen & I filed I 130 for my husband who lives in Pakistan, I live in Texas. I filed his paper work in October 2011 via greencard. I had it switched from greencard to citizenship in January 2012. I do have a lawyer but as we all know they give all their clients the run- around. My case has been went to California. What's going to happen next. How long will all this take. This is all very disheartening. :( :(

You had a green-card ? Also can you fill in your timeline this will help others better understand where you are at and what service center is serving you. Have you received any RFE's (Request for Further Evidence) from USCIS.

If you are asking about the timeline you have now passed the 5 month mark. But its not like written law that says they have to be done in 5 months. Have you called USCIS to ask about your case. Or checked on the USCIS.gov website (you did register your case so you can check?) . .

Sounds like it used to be an lpr filing who got naturalized. sadly, i dont know anything about that.

08/2006 met in GA, U.S.

05/2007 Antje had to go back to Germany

10/2009 got engaged in TN

12/31/2009 got married

1/7/2010 I-130 sent

1/9/2010 I-130 delivered

1/13/2010 check cashed

1/15/2010 NOA 1

3/18/2010 NOA 2

Sorry if I don sound too clear. I became a citizen in the beginning of January 2012. I sponsored/filed i130 for my husband via Perminent Resident. I had it petitioned to Citizen in January 2012. I'm currently in Texas and my case was sent to California. As of right now thats all I know....

I would call uscis talk to a tier 2 operator and verify that your status was changed to USC instead of lpr

they will update your case. and let you know what should you need to do.

So I got in contact with USCIS.I spoke to an Officer. She told me that she would put a service request in to ensure that the process gets resolved within the next 30-45 days.

What the HELL ado does this even mean....?!? ???????????

It means exactly what the officer said it means. Since your application has been pending since 2011 and you are now a citizen, they are going to adjudicate it within 45 days.

Did you confirm from the officer that your petition was being upgraded from LPR to USC?

What you should do is file a new 1-130 with updated information, attach a copy of the previous receipt of 1 130 and your citizenship proof and write a cover letter explaining everything about your change of status and send the whole package registered mail. This will solve the confusion and make sure to keep a copy of everything you are sending. This is a more sure way rather than relying on an operator on a phone and wasting 30-45 days just in case it doesnt get done.

I think a 'service request' was not needed.

Hadi - did you get a Tier 2, an ISO ? If so -

you should have told the ISO that you, the petitioner, need to update yerself with their office,

from an LPR

to

A USCitizen.

There's a simple intake for this, an ISO will tell you exactly what to do, how to do.

IMO, a service request was not needed for this.

As to 'attorney of record' for your case -

well, attornies can either be trained (by you) or roasted over a slow fire pit - yer choice.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I got a letter from USCIS & it said that my petition has been updated to citizenship from LPR ??

Great, so you're on the timeline for USCs instead of LPRs now, which means that a visa is immediately available, and the I-130 is eligible to be adjudicated now.

What you should do is file a new 1-130 with updated information, attach a copy of the previous receipt of 1 130 and your citizenship proof and write a cover letter explaining everything about your change of status and send the whole package registered mail. This will solve the confusion and make sure to keep a copy of everything you are sending. This is a more sure way rather than relying on an operator on a phone and wasting 30-45 days just in case it doesnt get done.

This is not necessary--people frequently change their I-130s from LPR to USC, usually by submitting proof of naturalization. It can be advantageous to switch the petition from the LPR shelf to the USC shelf instead of re-filing because there may have been work done on the I-130 already, and you can avoid fees, etc.

Yay!!! I opened a letter today from USCIS 23 April 2012. It said that my i130 has been approved and someone will contact the beneficiary... My lawyer also emailed me and said to just wait for 6-8 weeks before starting the consular process.

??????

- How much longer now?

- What is a consular process?
