My mom is trying to file for her siblings. Yes I know the process is way too long but she still wants to go with it.

I am trying to help her file but I am getting confused about what needs to be sent with her I-130 forms.

So far, we have:

Form I-130

Her birth certificate

Copy of her U.S Passport and copy of her Naturalization certificate

Her sibling's birth certificate

Sibling's marriage certificate

Sibling's husband and childrens' birth certifictes

Passport size photo of the sibling, husband and children.

What else is needed? Can someone please help? Thanks!

you don't need the majority of the documents listed, I wrote no to the majority of them

she only needs to file with the i130, both copies of birth certificates to prove that they are siblings, and proof of citizenship, the rest of the documents are presented at the NVC stage in more than 10 years from now.

if the birth certificates aren't in English, she needs to attach a translation in English. and it's only one proof of citizenship, or passport or copy of naturalization certificate, not both. I did put her birh certificte no, but it is yes. that was incorrect.

the i130 is to prove the relationship between siblings, the other things will be sent with the rest of the forms and payments when the priority date beoomes current.

Read the Guides; http://www.visajourney.com/content/ussibpet Most of what you have listed is not needed to file the I-130. The rest will not be needed for another 12 years. Husband and children's birth certificates and passport photos are completely unnecessary.

Essentially, the I-130 needs to show the following information 1) prove the petitioner is a US citizen, 2) prove the petitioner and beneficiary are siblings, and 3) prove they are who they are if there has been a name change.

1) is easy - photocopy of US passport.

3) is easy - legal documents showing name change or marriage certificate if the wife took the husband's last name.

2) is not hard - prove they are siblings. Same mother - mother is listed on petitioner's birth certificate and beneficiary's birth certificate. Same father but different mothers - need father's marriage certificates. Born out of wedlock - more docs.

DO NOT SEND IN ORIGINALS WITH THE I-130. ONLY SEND PHOTOCOPIES. The photocopies are just regular copies. You do not need to notarize them.
