Hi,

I have a pending petition and I am under F1 visa. I want to visit USA and see my mom. I still have to wait 11 years for a visa to be available. Can you please tell me how could I visit USA and have 2 months vacation... I understand that it is very difficult to get a tourist visa here in the Philippines specially if you have a pending petition... :-(

Can anyone tell me if there is a possibility that I could get a tourist visa????

Yes, it is possible to get a tourist visa with a pending immigration petition.

No one can tell you what your chances are. It's zero if you don't apply. It's better than zero if you do apply.

As a tourist visa applicant, you will need to show strong ties to the Philippines. All tourist visa applicants are presumed to have the intent to illegally immigrate to the US. You will need to show why you will return to the Philippines after a brief visit to the US.

It's possible to get a tourist visa if you have a good paying job in the Philippines, close family in the Philippines, real estate in the Philippines, and other connections to the Philippines.

If you are poor, have lots of close relatives in the US, have few close relatives in the Philippines, and few ties to the Philippines that you can provide evidence for, then it is unlikely you will get a tourist visa.

F1 visa is student visa...

Anyway, if you have a pending petition it can be difficult to obtain a visa.

To better your chances, picture yourself in the CO's shoes.

His/her job is to make sure tourist visas are only issued to people whom they believe will be going to the US for the sole purpose of visiting. Their job requires them to make sure they believe that you:

1. Will leave the US prior to the date written on your I-94.

2. Will not seek to work while you're there.

3. Will not seek to study, or engage in other activities not allowed by your tourist visa while you're there.

US immigration law requires consular and border officers to assume that any visitor is an intending immigrant. it is your job to sufficiently prove otherwise.

There is nothing illegal about visiting your relatives in the US while a petition is being filed for you, but it strengthens the CO's case that you do intend to immigrate, and won't leave the US once admitted.

So think. What documentation can you show at the interview that will prove you have ties to the Philippines and will return? Do you have a steady job there? Do you own property there? Car? Do you go to school there? Do you have any important events coming up in the Philippines that you need to attend after you return? Can you document any of this?
