when it is out of the 5 months processing time, then by all rights you should protect your family time. you had done your part and now it is time for them to deliver their end of the promise.

it is not a waste of everyone's time. why should those lovers suffer in exchange for not wasting someone else time? why is it that we should diminish our quality of life for waiting for our spouse?

Because if you ask for an expedite it is immediately put at the front of the line, in front of everyone else who has been waiting. Therefore, those people who have been waiting wait for even longer. UNLESS they have a special department that JUST does expedite.

Let's make sure I'm totally clear though: when you say ask for expedite that means someone goes about it the same way they would if they needed to have it expedited for medical reason, right? You have to have a problems other than "omg I miss my spouse sooooo much" to get something expedited, even after 5 months, right??

Maybe I'm just bitter because I'll be waiting another 6-10 months after the i130 approval comes in addition to the ~5 months I've already been waiting. So, sorry, but when people go on about having to wait for 5-7 months I have no sympathy. I'll have been without my husband for ~18 months total by the end of it (due to immigration jail BS, too); and that's only if everything goes smoothly, so...

the reality is that you need to defend your turf. you can encourage other members here and believe your persuasion here. you just persuaded the tip of the ice berg while there are thousands of others that will still expedite their case. why go against the flow? why risk your family time?

you have every right to be pissed losing your family time. and i suggest you bring hell to uscis and not your fellow vjers... we have the same goal - that is to bring our spouse to the united states to start our family. seriously, i want to have a child this year... but no way i will make my wife bear pregnancy all alone and go through xrays for the visa.

I wish you the best of luck. I know how hard it is to have a child alone -- I gave birth while my husband was in immigration jail. I went through the last 5 months of pregnancy by myself. He didn't actually get to physically hold his daughter until she was 5 months old. My point is: you never know what you're capable of until you go at it. I know we all want our spouses home... but just reiterate that: we ALL want our spouses home. No one is anymore special than anyone else.

i do not have the personal experience similar to yours. but i am sure that is it quite close as being single-mothers. i learn a lot about single mothers in a education policy perspective, especially the financial and emotional needs going to college. it breaks my heart that they (single mother students) are not able to pursue their true potential.

i strongly encourage you to talk to your politicians to here your story. i can say that some politicians are passoniate, players, or ignorant. it also helps you to vent your distress and share your problem with others. don't try to be selfish holding it in because it would only hurt you in the end.

I may do that in the future but honestly it just seems to be wasted breath :( there's people out there who have it a lot worse than I do (ie; the women and men who are ripped from their spouses, thrown into jail and deported with NO CHANCE of coming back -- especially the ones that have kids!! Kids get thrown into foster care and have no clue what's going on and where mommy or daddy is). I digress; as far as writing my senator/congresspeople they don't really care either. Matter of fact the only one who offered to help had a really snooty immigration case-worker LOL I've kinda given up on it. And as our ol' buddy USCIS says I'm "within processing times" so there's nothing I can do :wacko:

don't give up! if he doesn't come, you can go to him. if you do, make sure you get a hold of a reporter or someone to make a splash on this. let them know you are suffering because of uscis.

foster care is a whole another story. it is for agency funding reasons. no foster child = no need for staff = no need for funding = lost political support. you get the gist.

writing? no one truely reads nowadays. if you can't pack it in one paragraph, forget about it because politicians have short attention span for reading letters. they have a mountain pile of paperwork which is shorten to a half pager by their staff/analyst for them to read. you may not get to speak to the politician but only their staff. hopefully you can find a sympathetic staff that is sympathetic to your needs. if that case worker doesn't work, request for another one because of irreconcilable management.

You know though, you were right when you said something (and I quote loosely) "everyone should fight to be reunited with their spouse." You're freaking right! We shouldn't have to stand for this separation! You think you have a reason to expedite, try it and see. You push other people back? Who cares (no seriously...). It's every man for himself in this game. There are probably TONS of other people out there who are asking for expedites, don't come to VJ and don't pay two thoughts to people who were "waiting before them." Family is the most important thing and it's up to USCIS to decide if your expedite meet criteria. I've had a total change of heart! :blush:

i also suggest you to ask about the possible outcomes because you mention that your husband been to immigration jail. the severity of the charge has a big role in determining their approval.

i also suggest you to ask about the possible outcomes because you mention that your husband been to immigration jail. the severity of the charge has a big role in determining their approval.

From my understanding the i130 application will be approved but the visa itself will be denied and he will be barred from getting one for 10 years. We should be able to submit an i601 (waiver of extreme hardship) to overcome the bar and have him back by 2/2013 (that date is completely my assumption, based on my "calculations" of maximum time allotted for processing of each step). I don't see why we wouldn't be granted the chance to submit a waiver -- he only EWI once, little to no criminal history, etc etc
