Hi everyone,

I really need help on this one. My wifes friend is married to a US citzen and is an reserved national guard and prevouisly was a Marine. She has gotten her 10 year green card and this evening He got into a fight with her about sending money home to the philippines and told her to get out of my house and He wants a divorce. My question is what does she have to do now if He Files a divorce to become a citzen or will she become deported like He threated her already. Please advise me on this guys

Moved from IR-1/CR-1 Process & Procedures to Effects of Major Family Changes on Immigration Benefits forum.

She has the 10 year green card, unless it was obtained by fraudulent means, she will not be deported. If there is a divorce, the Affidavit of Support the petitioner (and any joint sponsor) signed is still binding. If she decides to apply for citizenship, I don't know which clock (3 years or 5 years) comes into play when a divorce is involved.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Unless it was obtained fraudulently, the GC is hers. He is not part of that relationship she has with the government. He can divorce her, he can report her to immigration control, but unless she married him to get the GC and can absolutely prove it, there's nothing he can do to affect her status here.

He cannot kick her out of the house. She has right of abode. Personally I wouldn't want to stay, but she doesn't HAVE to go. It's her house too as they are married. Only if SHE moves out can he then change the locks etc.

Status wise she's fine. They are simply empty threats on his part unless he has proof she used him for the card.
