Hello,

We filed the I-130 Jan 10 and the I-129f Feb 13. My husband overstayed 9 months when he was previously in America. That was a year and a half ago. I realize he his subject to a 3 year ban. When do we file the I-601? I noticed on the instructions that the I-485 has to be submitted and approved first. But I was told we dont fill out the I-485 until he is granted his k-3 and is admitted into the US. Though he cant be admitted into the US since he overstayed. Any help is greatly appreciated. :unsure:

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.
