Hi, can anyone please tell me what the process would be for a minor stepchild of USC? I already have an I-130 pending but what I'm curious about is on the immigration visa application for my wife (outside the US)it has a place to list minor children but will my stepdaughter need her own immigration visa application? If someone can shed some light on the process and how it all comes together I'd greatly appreciate it. My wife's 1-30 has already been approved and affidavit of support has already been submitted after it was requested. We're currently putting together my wife's immigration visa application. Thanks!

Your stepdaughter needs her own I-130.

You petitioned your wife as an Immediate Relative. Derivative beneficiaries are not allowed in Immediate Relative cases. Therefore, you stepdaughter needs her own I-130. Listing the child on your wife's I-130 was for informational purposes only - you did not apply for any immigrant benefit for her daughter.

The process for your stepdaughter is almost exactly like the process for your wife; I-130, I-864, and DS-230.

When you petition for your stepdaughter, request an expedite based on the fact that her mother's case is currently at the US Embassy. Your wife should also asked that her case and her daughter's case be processed together at the embassy, so they will bot get visas around the same time and be able to immigrate to the US together.

Thank you Aaron, you've taken the mystery stress of having to "wait and see" out it. Thanks again!
