Hi!

I am just wondering if anyone knows exactly what information is recorded or saved during the tourist visa interview.

In 2010 my boyfriend who is Chilean petitioned for a tourist visa to the United States to come visit in March - he was denied and then reapplied and was granted a 90 day tourist visa and was able to come visit me in the states in July..We then returned to Chile together and have been here ever since

When he applied for the tourist visa he did not mention that I am his girlfriend - he said he was visiting a friend - I also wrote him a invitation letter, inviting my "friend" to come visit me... I know that is lying but I had heard that they will automatically say no when they hear the word girlfriend or boyfriend assuming it is a pretty good reason to overstay your visa .. he said the lady seemed a little suspicious but still gave him the visa because he had proved reason to return to Chile

In July we both plan on going to visit my family and attend a wedding. His idea is to tell them at the embassy that he is going to visit his girlfriends family for a wedding...the truth. Hopefully they will see that I have lived and worked in Chile for the last two years and will assume he is not trying to move there - We also we plan on applying for a K-1 Fiance visa in July so that the can come next year and live in the states

So my main questions are :

1. Do they have it on record that he visited a friend in 2010? Do they have all that information detailed or do they simply have the dates and that he qualified for a visa? This is important because if they have it documented that he visited me as a friend in 2010 but see in the K-1 petition that we have been dating for 3 years and that he even came and visited me during that time - we would be caught of lying in 2010 which I assume looks bad

If that is the case we plan on explaining that trip by saying we were friends at that moment but did have history, then after his visit we decided to stay together - easy to cover up but I would rather not do that if its not necessary

2. When he is applying now should he tell them that we are planning on petitioning the K-1 visa later in the year or leave that out?

1. Always assume that they know, becuase they generally do. Always tell the truth, then nothing to 'cover up' in the future

2. No, do not mention the K-1 unless asked

What will be the best to his benefit are his ties to Chilie, what are those?

Before I realized that my then-boyfriend had little to no chance of ever being given a tourist visa to visit me here regardless of whether he was known to be in a relationship with me or not (due to his home country, lack of strong ties, etc.), I considered trying to conceal the relationship to increase his chances of getting approved (by having someone else invite him, or posing as a "friend"). And I thought of the same problem: that if we ever applied for a family-based visa, we'd have to directly contradict what we had already told the U.S. government. We'd be trying to prove that we had a real relationship during a time when we also insisted that we did not have one. If people have had problems resulting from information that they disclosed in another place entirely (Facebook, here, etc.) then it doesn't seem like a stretch that USCIS would be aware of information that an applicant has told USCIS previously. I would be very concerned.

Dec. 27, 2010: First met each other in Entebbe, Uganda while I was visiting my friend/his cousin (12/27/10 - 1/10/11) (visited again Jul. 2-9, 2011 and Dec. 24, 2011 - Jan. 9, 2012; engaged 1/7/12)

Feb. 18, 2012: I-129F sent (delivered 2/21 per USPS & USCIS; NOA1 notice date 2/23/12; check cashed/email/text 2/24)

Aug. 9, 2012: NOA2!!! [NOA1 +168 days] (reached NVC 8/17, left NVC 8/20; @embassy 8/24; embassy confirmed receipt 9/5)

Oct. 24 - Nov. 8, 2012: I visited again (Nairobi: medical 10/31; interview 11/5 [NOA1 +256 days]; result--APPROVED!!!!!!!)

Nov. 15, 2012: Visa in hand (was ready for retrieval 11/12/12)

Nov. 20, 2012: POE, Boston!!! (legal marriage 12/12/12; family/friends wedding ceremony 1/12/13) (276 days)

AOS/EAD/AP

Feb. 4, 2013: AOS packet sent (delivered 2/6, NOA1 text/email & check cashed 2/11 midnight)

Feb. 11, 2013: NOA1 notice date for I-485, EAD, AP (I-485/EAD NOA1 hard copies & biometrics appt letter arrived 2/16, badly mangled AP NOA1 arrived 2/27; biometrics done 3/4/13)

Apr. 3, 2013: EAD & AP approved (received card 4/11)

Aug. 16, 2013: I-485 approved & green card production ordered!!!! (card arrived 8/26/13) (193 days)

ROC

2015 sometime? I've slept since then.

Naturalization

Dec. 20, 2019: N-400 submitted online (Boston, MA field office)

Jan. 9, 2020: Biometrics

Feb. 4, 2020: updated wait time = 4 months (estimated case completion June 2020)

Aug. 7, 2020: interview scheduled (!), but no idea when

Sept. 16, 2020: interview, Boston (approved)

Sept. 24, 2020: oath ceremony, Boston---DONE!!! (279 days from submission)

Well when he got his visa in 2010 his main tie to Chile was that he was in his fourth year of the university going to visit the United States in between semesters - which meant he had already paid for the whole year - he showed this document - his father also has his own small printing company, and he showed proof of that and his grandfathers bank account who would be able to send him money just in case - he went to the US on that trip with just enough money for the plane and some spending money.

I am pretty sure his schooling was the main reason he got in, and luck really..

So since we have already made the mistake of getting his first tourist visa on false pretense of us being "friends" (can't take this back) what would you suggest we do now for the K-1? For his tourist visa now he will obviously now tell them he is going to visit his girlfriends family - and probably omit the future plans of the K-1 visa - they don't need to know that we are already planning that - technically he could propose to me after he goes the the US - so there is no lie in that

I thought of just putting our relationship back a whole year - instead of saying we have been together for 3 year on the K-1 petition say it was 2..we have been dating for 3 years - and in the first year I went to Chile to visit him and he came to the US to visit me...

I don't know if it is better to just hope they don't catch the fact that he called me his friend when he came as a tourist in 2010 - or cover it up - We can easily say that we still met at the same time but weren't together ( if they ask ) and we started dating after he came to the US - and that is why I came back to live in Chile .. My trip to visit him in Chile in March 2010 doesn't really need to be explained I guess - I could have been visiting friends and my host family right?

I mean it could even be explained that we weren't dating at the time - that we had broken up since we would be in different countries.. but I assume they just reject things that look suspicious instead of giving you a chance to explain?

This is stressing me out now! We didn't really think about future visas 2 years ago, we just missed each other and wanted him to be able to get to the US and now I realize that might have been a BIIIG mistake.. I am not worried about them thinking our relationship isn't real - we have a lot of proof of that our relationship is real - but this is worrisome

Simply tell the truth. If asked then tell the truth, why are you trying to make this exponentially harder than it is?

Because he already lied two years ago about us being together- so you suggest that if they do catch that we just tell that yes he did lie - won't that automatically deny him that visa?

If they ask why 2 years ago he didn't say girlfriend he says he didn't realize there was a difference.

That's actually a lot better - the idea of covering it up is just stressful and making it more complicated and would probably be completely unnecessary - and I actually think the probability that they will ask why he didn't call me his girlfriend is very low - but its good to be prepared just in case

Hopefully that little omission a few years ago won't put his visa at risk! Thanks! You are completely right that covering up a lie with another one something that I do not want to do!

So tonight when my boyfriend got home I asked him if he explicitly told the person that interviewed him that we were not dating.. he said that the interviewer asked him about 3 or 4 times if he was sure that we weren't dating and he told them no that we were not multiple times..

Which means that acting naive about the situation really won't work if they have that conversation on record - which I am sure they do

It would be nice to know if they would they appreciate him fessing up to lying or if that would just get him an automatic no to the visa.. and banned from the US for some year
