She packed up her belongings and left. She took her things, so she hadn't been abducted, she is not missing. That is not a police matter. Unlikely anyone would pack up and go, and be found by ringing around the hospitals. And if she has packed up and gone, with no word, why would he. She clearly has no interest in continuing the relationship.

I can explain it to you. But I can't understand it for you.

Maybe he can be the responsible one. From the psychological stand point, it is unhealthy for him to go on without disclosure.

Even if he locates her, the relationship is over. He would only be trying to stay with her for his GC, which is fraud.

And I take it you meant closure? Some people never do get closure. Sometimes it isn't possible. A lot of the time it's over rated.

I can explain it to you. But I can't understand it for you.

That she left without any forwarding address just when she knows your AOS interview may be coming up speaks to her intent...you may stick around and see if your AOS is adjudicated without an interview. You may also want to reschedule if and when you are sent a notice for an interview.

i came to usa in 2002 with J1. was without papers till i married her in 2011

Ah. Then you're definitely going to have an interview. She won't be there (unless you reconcile in the meantime) so your AOS will be denied and you will be ordered removed. You will have 30 days to leave the US or file an appeal (but you wouldn't file an appeal unless you have new evidence and even if she was to come back in time for that it'd be hard to prove a true marriage when she ran off already).

Once you leave the US you will enact a 10 year ban due to your large overstay and you will be unlikely to EVER get a visitor visa to the US.

can it possibly be that they will not depart me from the usa if i hire a lawyer in my case?

No not really. She ran off. She didn't abuse you. It's highly unlikely they can do anything to help you but it doesn't hurt to get a consultation to see what they think (bearing in mind some will promise you the world just to get the fees from you).

It all depends on what really happened.

The law is not unreasonable. At crux is what you did, what she did and why you both did what you did.

You may get a GC without interview, but it will be valid only for 2 years.

Then you will have to explain what happened.

If you get denied right away then you will be placed into removal proceedings.

There, before the judge, you can explain your case.

Note: the above is NOT a legal advise. For legal consultation consult the practicing immigration

attorney.

Please do not misinform - he is not going to get a GC without interview.

I share an opinion, I am not an immigration attorney and expressly state so.

As to GC without interview, if he adjusts from K visa he already was interviewed

and USCIS may not find it necessary to interview him once again ( IF he is adjusting from K visa. I do NOT know what visa he is adjusting from and I did NOT say he WILL get GC without an interview, but he MAY. Big difference if you understand plain English).

Well, no doubt I overlooked it if I said I do not know what visa he is adjusting from.

If he came on J visa and filed AOS then he won't be allowed to proceed without interview.

Again , interview now or later, the crux of the matter is what exactly happened, why his wife did what she did and

so on.

You didn't clearly stated in your post the reason behind why she left you. Whatever it is or what's happening between you and her, check on the IMBRA pamplet if you can be categorized as a victim of domestic violence. To be a victim doesn't mean only to be physically abused but they are a lot of factors that can be consider as to be one. Try to visit www.uscis.com and search for IMBRA. Read everything related to it and you might find some answers and helps that you may need.
