Hi,

I have been living with my fiance off and on for the last 3 years in Ghana. I go to Ghana and stay for 3 months, then come home to the US for about 5 months...then back to Ghana for 3 months, etc. He is Nigerian but has been living in Ghana for about 4 years. We are going to get married the next time I go there and then I would like to file a petition for him to come to the US. Would I file the I-129, I-130, or which one? Im a little confused by the two of them. Thanks for any help!!

There is an excellent comparison of the fiance(e) and spousal available in the VJ comparison Guides . Reviewing them should help you and your fiance in your journey.

Good luck.

If you are already making plans to marry in 4 months or so, I would suggest you wait, get married and go the I-130 route because the I-129 visa wont be approved before you get married and thus disqualifying you in the middle of the process and having to start over with the I-130.

Hope that helps
