We got married in Costa Rica and currently I am a CR resident and Turkish citizen. My US citizen husband lives here as well but he is not a resident. He wants to go back to the States as soon as possible because he can not find a job here and we are running out of cash. We want to pursue the CR1 visa route and apply with the Chicago mailbox and wait here for the interview. However, the CR visa process is long and I dont want to be here by myself with our newborn baby. Can I go back to Turkey and wait there during the process? At least I will have my parents support, I dont want to be here by myself for 9 months or more with our baby and no money.

About us, we are married in CR for about 6 months. We have a son, he got a US passport here at the embassy.

Many thanks!

Being that you are a Citizen of Turkey, its OK for you to move back home to Turkey and then have your husband (USC)file the CR1 I-30 Visa petition on your behalf to the Chicago Lock box. Your interview will then be at the Turkey Embassy just remember to get a police clearance before you leave Costa Rica.

Good luck

It's perfectly fine for you to return to Turkey. When your husband files the I-130, he should list your address in Turkey.

The USCitizen has been in Costa Rica more than 6 months, that minimal span o time IF DCF'd I-130 intake was available?

If so -

study this a bit -

http://www.visajourney.com/forums/topic/357465-usc-petitioner-living-abroad/

as that first stage of waiting, at USCIS, seems to have melted for those who FORMERLY would have filed via DCF.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
