Ok, heres my story I am married for about 3 1/2 years now to my wife. Every year I go back home to visit her and stayed for a couple months. June 2011 I got my US citizenship and file a petition for her, and the problem is she got pregnant by some guy (her ex or co worker she wont tell me). But i really love her so i decide to continue the petitions or im just fool? Anyways the baby was born on November 2011 and on her birth certificate shes using my last name and im the father, even though im not her biological father. On my petition paper it was only my wife name and I told my lawyer the baby was born and ask my lawyer what to do. My lawyer told me just to wait until we got some paper works. My lawyer filed 2 different of petition 1 is I-129F for Fiance and the 2nd is I-130. I got my approval letters about 2 weeks ago now, my lawyer told me I have 2 choices, try to get the k3/k4 visas or wait for the I-130, so I told her let me try the k3/k4 because I did some research about it, and I found out that my wife can come here in US while waiting for a green card. So I send the approval letter (I-129F) to my wife in Philippines, but when she went to do US embassy they told her she cannot do the K3/K4 anymore because the I-130 is already been approve. So my lawyer told me just to wait for the letters from NVC (National Visa Center). It will take about 1 month then im going to pay a fee of 500+ i think it was 400 something and 90 something dollars. Today i received a letter from NVC but not the papers works yet, its just a notice that they receive my application and everything. And my question is do I have to file a separate paper works for my wife daughter which is only 4 months old. Its friday night here so i wont be able to ask my lawyer until monday. Thank you

I think you are nuts....second of all get your name off that birth certificate, if she fools around on you once she will do it again.

Sorry for your situation but your Lawyer should have given you 3 choices.

The babies Birth Certificate is a Fraud and you and your Attorney know it but proceed with the paperwork anyway. Your Attorney should be advising you on the proper conduct and disclose facts.

Whether or not your wife commited Adultry is your choice and the baby is not yours. To lie on any documents to USCIS is fraud and will result in a bad ending.

If your Attorney is agreeing to Submit a False Birth Certicate to USCIS, then get other Counsil. I mean get real: She will be asked if the baby is yours eventually. And if she/you lies: Its Over.

Reasonable Doubt by USCIS could lead to a DNA Test.

Tell the truth. That Attorney seems to be unethical and sucking your wallet blindly because of your heart.

Just my thought.

I think you are nuts....second of all get your name off that birth certificate, if she fools around on you once she will do it again.

I already know that, and its already been done. I gave her a second chance, nobody is perfect. All i just want to know if i should file a petition for her daughter? Now im just waiting for NVC to send some paper works and what to do next.

My lawyer was refered by my moms friend from church and actually already helps a lot of people from our church. If you will see our church have a lot of Filipino its only because of that lawyer, and they only asking for a small fee which i think is cheap. So I need to talk to my lawyer and ask the real situation. Oh by the way, we never process anything about the baby yet.

See my post above. Did you submit the Petition stating you are the biological Father. Did you or did you not ?

Also, Generally Attorneys do this if you have one.

The paper is on process but like I said we didnt put anything about my wifes daughter.

yeah, thats why im just asking for some advice, so if my wife gets here she can file a petition for her daughter.

I have a friend that she came here to united states as tourist and then married a US citizen after 6 months she file a petition for her daughter (shes 14 yrs old) back in Philippines. In less than 6 months she got her daughter, and same lawyer that helping me today, this happens 1-2 years ago.

I could be wrong, but if the child is born outside of the States, isn't a DNA test usually required?

If they are trying to claim citizenship but they have no claim, the child is not his.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

If they are trying to claim citizenship but they have no claim, the child is not his.

yeah no claim, as far as i understand from my lawyer I think they trying to get my wife visa and carry the baby with her since shes a minor. Im just confused right now sorry.
