Can we DCF if i left to USA for 2 months?

hello all

my situation is,

i have lived off and on in peru for the past 3 years normally spending on average 6 - 8 months out of the year in Peru, and then working in the states for a few months out of the year.....

wondering if i am still valid to DCF for the Spouse visa?

most recently my situation is, i am pregnant and have been in peru but have decided to come back to the states (alone) to have my baby in the USA.....by the time i return to peru i will have probably been out of peru for 2 -3 mnths....

does this affect my ability to DCF?

or upon my next arrival from that time i need to be living there 6 months?

any advice greatly apreciated!

Where are you officially residing? Ie when you file taxes, do you do so as resident in the US or resident abroad? Do you have a lease/ own a home in Peru? Have bills with the Peru address? If yes, I would think you can file directly in Peru.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
