Hi Everyone:

I just became a US Citizen and I will like to petition for my mother and brother. I pretty much know about the timeframes and what I will like to know is:

1. What is the first thing that I have to do? Do I have to sent only the I-130 for my mother and brother (one for each) and then wait until they ask me for more information and forms? or do I have to send additional information with the I-130?

2. The affidavit of support, is it sent with the I-130 or immigration will ask for it later on?

3. What will be the income that I have to show in order for the affidavit of support to be ok?

Soooo many questions....

8/31/12 - I-130 Approved.
10/10/12 - I called NVC and received via email DS-3032 and AOS bill.
10/11/12 - AOS PAID.
10/15/12 - My mom sent via email the executed DS-3032.
11/2/12 - IV PAID.
01/29/13 - Sent IV package and it was delivered 2/6/13.
2/6/13 - Sent AOS package and it was delivered 2/13/13.
2/16/13 - Received email from NVC with checklist.
2/20/13 - CASE COMPLETED
2/22/13 - Sent photos as per checklist and they were delivered 2/26/13.
2/27/13 - Received email saying that they had all necessary documentation.
3/6/13 - Received email scheduling interview for 4/12/13.

4/12/13 - Passed Interview. 5/20/13 - Entered USA.

12/6/13 - I-130 Approved. 12/9/13 - I-130 shipped to NVC.

It is not sent with the I-130, it is sent to the NVC after the appropriate bill has been paid.

3. What will be the income that I have to show in order for the affidavit of support to be ok?

125% of the poverty line for your household size. Refer to the I-864P for exact numbers.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Hi, Im in the same situation as you my pd 2/21/12. From what I heard from others it will be quicker if once my mom gets her GC/USC that she petitions for my brother, im still questioning myself about petioning for my brother. I sent the i130,g325a,1145 forms with $420 personal check to the chicago lockbox. Good luck!!

You will need your birth certificate too and translate it if needed.

If you have the extra money to send a petition for your brother it can be a good thing. Should your mother die your brother would be stuck without your petition as insurance.

This will not be over quickly. You will not enjoy this.

I becase a US Citizen in 2007 and applied for my mother right away she had her interview by October of 2008, My mom came in early 2009. As far as my sister goes, we were disappointed to find out she had to be filed separately even though she was only 15 at the time. But my moom applied for her once she was here, everything is complete now and her PD is MAR 12 2010 so hopefully we get it soon. If I had applied for my sister it would have been longer, also is your brother under 21? The affidavit of support I sent in later when they asked and our PD became current (at the end of 2010 before retrogression). The entire journey can seem like ages, but just think at least they are fortunate enough to have you and this opportunity that many do not have. Good luck.

My brother's father passed a few years ago. Can he be expedite because of it??

No. There is a 12 years wait to petition a brother. There is nothing that allows him to jump the line ahead of all the other foreign siblings waiting to come to the US. Many of them probably have at least one deceased parent, so your brother's situation is not special.

I hope you were not offended by my post. My point was that lots of people have a deceased parent, so that is not a special situation that qualifies for any expediting.

They will sometimes expedite processing for humanitarian reasons. This means you might get USCIS to approve the petition faster. Unfortunately, there's nothing they can do to change the time when the priority date will become current. The amount of time it will take for the priority date to become current is determined by the annual limits in each visa category, which is set by law, and the number of people who are already in line waiting for one of those visas, which the US government has no control over. Since the priority date is based on the date USCIS receives the petition and not the date they approve it, an expedite wouldn't make any difference in the amount of time you'd end up waiting, so it would be rather pointless to apply for it.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Unfortunately, there's nothing they can do to change the time when the priority date will become current. The amount of time it will take for the priority date to become current is determined by the annual limits in each visa category, which is set by law, and the number of people who are already in line waiting for one of those visas, which the US government has no control over. Since the priority date is based on the date USCIS receives the petition and not the date they approve it, an expedite wouldn't make any difference in the amount of time you'd end up waiting, so it would be rather pointless to apply for it.
