Anne I feel your pain. It's funny, even though Jon has his green card now I was about to write my own rant yesterday when I heard about the tens of thousands of illegal immigrants lining up for EAD applications. Really got my blood boiling. What's frustrating is that now that EADs are given to legal and illegal immigrants I think it will hurt those that are here legally looking for a job. Considering employers already get a little suspicious when they see a job applicant is from another country, now even if they have an EAD they may wonder if you are here illegally. It makes me wonder if we should just put "I HAVE A GREEN CARD" in bold red letters on the top of his resume :)

Ibee you're right though even if they have the EAD they can't apply for legal status so it makes you wonder what the point of the program is since there's really no long term solution. Oh right, campaign season!

I'm sorry where exactly did I say we were afraid of competition or even mention the word competition??? You failed entirely to understand my point. My concern lies with that fact that human resource departments and companies in general are usually not that enthusiastic about an applicant that is potentially an illegal immigrant. For tax reasons, possible PR issues, legal issues, etc. a company doesn't want the hassle of having to worry about immigration status. Simple human nature. Therefore, I was upset that an EAD no longer necessarily means you have legal status in the country because people may make assumptions about the applicant and not even look at their resume if they see they have an EAD. I absolutely believe in hiring the best and the brightest and have never been afraid of competition. Jon will earn the job that he does because of his education and skill set, which may beat out other American applicants.

It is illegal to discriminate against someone who is the holder of an EAD when it comes to employment.

If they have presented an EAD as proof that they are able to legally work in the United States then that is it, they must be given equal consideration as any other applicant who is also able to legally work.

The only exception is that some jobs, particularly those in the federal government, require you to be a US citizen (naturalised or by birth makes no difference, unless you want to be President).

Technically yes, but people will still be people when it comes to what's going on in their minds when they look at a resume. Path of least resistance. That was my point. Just an observation.

Hey Everyone,

Yesterday we received an email and text notification regarding our AOS status being updated:

On August 23, 2012, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.

During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

For now the current status says "Decision" so we're still waiting on the Card Production notifications to eventually come through. I'm glad this part is over, because stressing over this is not healthy for my pregnancy. I'll update soon about the Interview experience we had back in July once I get the chance. Thanks to everyone who offered their support and well wishes to my Husband and I!

Hi RubikNewman! I filed my AOS application April 2,2012 and May 14,2012 was my biometrics. It's already transferred in CSC. Then now i'm still waiting on what's next. I keep checking my status online and still on Initial Review. :(

Sprite is also waiting without interview.

Hypnos, fingers crossed !!!!! It's almost the end of the month, hoping they have information for you soon.

Timeline

Thanks guys. Just a brief recap of my interview. Hialeah ASC. Appt time 10:15. The wait in the lobby was 1 hr. Smooth entry through security, then waited for my number to be called. We were called at 11:00am. Pleasant female officer. Essentially painless interview. No probing questions. Small talk about prior work she had in my home country. Verified personal info, discussed how we met, wedding, and photos reviewed, gave documents showing proof of relationship.She had mentioned that she would take my passport to copy something, but did not. Stated she would check the database for my H1B 797 after the interview. Signed paperwork regarding ROC, signed perjury paper. She did not take my work permit, she took my 194, some of my pics, and almost all of my supporting documents. Took 12-14 minutes total. Approved on the spot.For the records I took many things she did not ask for but took once i mentioned that i had them. My rfe was regarding work so i brought pay stubs, which she never asked for. She also did not ask for my bank statements after I handed her my other proofs. she said "yes, id like to see them". There was a storm in the area and I was not even sure they would be working, but she seemed pretty happy to be working in the midst of a tropical storm, and i am glad she was. Left at 11:13 am. Got emails and texts at 6:30 sharp.

05/03-bio appt rcvd. scheduled 05/21. hialeah ASC
05/08-RFE mailed.
05/12-RFE rcvd. USC husband 2011 taxes, proof of IO employment authorization???
05/14-mailed rfe requested info to MSC.
05/16-successful walk in at Hialeah. 20minutes no questions asked.
05/18- RFE response review email text 5:00 pm
06/22- Card/ Document Production
06/30-Ead ap combo in hand
07/24-interview scheduled 08/27/2012
08/27/2012-interview-approved. Texts/emails at 6:30pm
08/30- Card production texts
09/04/2012-Welcome to America. Green Card in hand!
