Calling USCIS for an Expedite - denied!

I think you must present why that humanitarian crisis and danger applies specifically to YOU and YOUR case.

Mentioning that a country is in turmoil and relatively more dangerous than others is not really a ground for expedition. Millions of people are living in war zone around the world.

Many countries have more dangerous living conditions than other but people have learned to live there in fear (Unfortunately). Otherwise, everyone who live in that country would be eligible for an expedition.

It is too general if you see my point.

Let me illustrate an example to you.

1. I live in Tijuana, Mexico which is notoriously one of the most dangerous city in the world. Literally, people are shot in the street, decapitated head are found on the sidewalk. I want to USCIS to expedite my case, so I can get out of here as soon as possible

Doesn't work as expedition ground because it is too generalized and impersonal.

2. I live in Pakistan, and I am politically active. I have a good reason to believe that my life is in danger. Some government agent is after me or I have received several threats from unknown person ( documented by a police report). My wife is also pregnant and the stress and living condition potentially put our baby health in danger (documented by a doctor evaluation and statement)

Now this case is much more likely to be expedited. The case and ground for expedition is personal.

The important thing is also how you formulate your expedite request because that gives USCIS the first impression of your situation.

I don't know how you did it but it has to appear like an emergency situation where the denial would most likely lead into greatly increased risk of humanitarian disaster.

Refer to my example 1, Tijuana is a dangerous place to live but an expedition deny doesn't make it even more dangerous to live for the applicant.

In example 2, a deny would significantly increase the risk of some bad thing happening because of the existing threats. The keyword here is time because expedite case is meant to reduce the waiting time right?innocent.gif

So you have to be able to clearly state that the humanitarian threat is getting higher the longer you wait for your petition application

While I clearly understand where you are coming from, must I get killed in a blast or in a lucky case survive with a lost limb to demonstrate that my life is in danger and please expedite my dead body???

If I were a poliitician in my country, trust me I would not even need any expedite. I could simply ask for a political asylum or would have made $50,0000 or more easily by corruption easily to get a business visa under treaty country with a processing time of 2 months.

I was in London when the bombs were going off, however I do not think that would have given me an expedite.

From a practical point of view if every case is expedited then there is no difference.

You've not written about that one part, at all; I sense it's missing .

Suggest the petitioner call back on Friday morning, get it all sussed out with as many humans as it takes (to get it sussed out).

Exactly. The petitioner was not told to submit any evidence, was not given any instructions on where to send it.

The Customer Service Representative from USCIS just told her that she will hear from them in 5 days. Nothing more. Petitioner has the evidence and was waiting to be asked for it but was never asked.

The request was dismissed without even looking into the matter.

So, +1 to you Darnell for noticing it.

Walking on the road never knowing if one would return home in one piece or in many pieces thanks to some lunatic suicide bomber. What hurts more is USCIS dismissing the request even without asking for any evidence and saying the request does not meet the guidelines. :facepalm:

I know what you mean, Im from Venezuelan and we have one of the highest rates of death by criminal situation in Latin america(including robbery, kidnap, etc etc) last year over a 14.200 people died on criminal situation (civils, criminals and police officers) No one is safe enough here. You can't go out with your cellphone, jewelry, or any expensive item. I love when my fiance comes to visit me but Im always scare because is TOO OBVIOUS that he's a tourist (He's Christina aguilera's blond jajaja, 5' 11',and blue eyes) when we're walking in a mall or something there're people staring at him and he keeps acting like if is still in the US. I've to take care of him all the time cause I guess he's not aware of the danger. He thinks like every country in the world it's like US.

We are not in war but we live in one. My fiance feels awful everytime he reads something, or hear the gun shots when we talk through skype. I've been robbed once like 6 month ago. A guy put a gun on my head and he only took my cellphone. When I told my fiance, he had blood pressure troubles and had anxiety.

He always says, "can't wait to bring you home". And can't wait either jajajajajaj. But I have faith on God and I know He's taking care of me.

My interview is in 11 days, hopefully I'll be home soon. BTW hope u can fix your situation, and be with your wife soon.

When my wife came to visit me, I had to get her dresses in local clothes so she won't stand out and luckily she is not blonde so it was not that bad but still I had to be very careful while bringing her out to move around.

I did get robbed in broad day light after I was coming out of a money exchange outlet. The robbers knew exactly where I had put my money so they put me on gunpoint and went straight for my pocket. Funny thing is that there was a Police checkpoint just 2 minutes walk ahead from the place where I was robbed. That is why I did not even bother to file a Police report. I thanked God that they only took the money and spared my life.

As for the expedite request, my wife called and was told that it is under some kind of "cooldown" and she cannot request again or do anything about it until after next 5 business days. I suppose the Tier 1 Customer Service lady who took the request did not key in the information properly and made it look like just an attempt to get an expedite for no reason and that is why the request was simply dismissed without even asking for proper evidence.

Musashii... I guess it depends on the person you speak with at USCIS for the expedite

We were in the very same situation a year ago and after waiting several months at USCIS decided it was dangerous enough to request expedite as my husband was walking home from work in the middle of the night because the buses and taxis were no longer running and he would pass places in which just an hour earlier a family would have been gunned down for no reason.

We spoke to a tier 2 told them about our situation used the travel warnings on the government site which were just updated to tell them about the situation and requested for humanitarian reasons. We were prepared to send/fax/scan plenty of newspaper proof and information about the events from many many news sources and government places but they never asked us for any proof. We never had to send anything in!! We simply got an email about a week later saying our expedite was approved and they would be getting his case file out to review and make a decision.

im still very worried about him but .. it really didnt do much good for us except to get an earlier interview date and there isnt any way you can expedite AP so here we are 9 months after our interview still waiting for this to complete and him to come home and finally be safe!

Im really sorry your not getting results that you were hoping for and im thankful you are safe after being robbed. Call and speak to a tier 2 person give it a week or so before you call back..wishing you luck!

Thank you EAbbas. Even if we can't do much here but your words of hope and prayers are still helpful. I hope that your husband can make it to you soon.

As for the AP thing, I have a strong personal opinion. Its purpose is to push the couples to the limits and break them down, nothing else. When a government office or agency is conducting name search or background checks, it does not take 9 months. If that was the case, how do they track the "wanted" people? Do they really wait till 9 months before search is complete and only then they take action? I don't think so. They have enough resources. I have heard enough stories of the official agencies locating their targets and taking necessary action within hours and those are local stories. 1 - 2 months I would understand but 9 months or longer? I believe that is just some bull #######. There is nothing wrong with their database, it being slow is just a lame excuse but since we cannot do anything about it, we just have to listen and wait.

As I understanding it, it is not the database check, it is the subsequent manual investigation, they could of course do it quicker, they could do the whole process a lot quicker.

Just an update:

Called USCIS-CSC on March 23 2012 and talked to a tier 2 officer this time. Was told that I-130 is under some cooldown and I could only request for I-129F. Officer asked questions and said he hopes I have the required evidence and I told him I have it.

March 30 2012: Letter reveived from USCIS-CSC stating same old thing. Denied. Without even asking for any evidence once again.

Make a guess? Our expedite request was denied twice. We were not even asked to submit any evidence at all to show them or tell them anything. That should tell you something. You can try though and you just might get lucky.
