Hello everyone, long time lurker here. I am applying for AOS soon, only pictures left to take, however I have been getting paranoid about my status. My B1 status is going to expire in August of 2012, although there is a chance I will have a green card by then, there is also a chance I will not. My question is: what will happen if my status expires while the AOS is pending? Will an AP cover me? Will an EAD cover me? Should I apply for extension of my B1 now before starting the AOS process?

03/28/2012 (Day 0) - Concurrent filing of I-130/AOS (with EAD and AP) mailed to Chicago Lockbox
03/29/2012 (Day 1) - Package delivered to Chicago Lockbox, confirmation received.

Are you sure you have a B1? Are you from Canada? A B1 is usually given 6 months validity. DId you enter the states just a month ago? Once your AOS packet is accepted, you enter a new period of authorized stay, so your status, whatever it is, will be void anyway.

I am pretty sure it is a b1 and mine was granted for 1 year because I am undergoing a non-paid internship. I entered the country last year in august. I know this is weird for a b1 but most ppl from my university receive this 1 year b1. So once my AOS packet is accepted I have a new period to stay? Accepted you mean received? They give me a number? And does the AP form allow me to exit and enter the country if my B1 is expired? Thanks again so much!!!

Once they issue this NOA1 (receipt) your new period of authorized stay begins. Your B-1 is also void at that point so don't try to leave the country until you have AP. AP takes about 2 months and you can travel using that until your GC is approved.

10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!
