AOS on B1 status

Hello everyone, long time lurker here. I am applying for AOS soon, only pictures left to take, however I have been getting paranoid about my status. My B1 status is going to expire in August of 2012, although there is a chance I will have a green card by then, there is also a chance I will not. My question is: what will happen if my status expires while the AOS is pending? Will an AP cover me? Will an EAD cover me? Should I apply for extension of my B1 now before starting the AOS process?

As soon as you file AOS, you are authorized to stay legally while it is processed. No more B1 so you don't have to worry. You would need Advance Parole to come back if you leave the country.

AP is routinely approved - I have never seen anyone get a denial for AP, as long as the forms were correctly filed.

The NOA1 from AOS doesn't prove anything other than having a pending AOS however carrying a copy of it around won't hurt you in case you're questioned(which rarely happens). You can't use it for anything(driver's license etc). If you file AOS before your lawful stay as a tourist is up, they'll be "overlapping" each other. It takes 90 plus/minus days to get EAD/AP. Just don't leave the country while the AOS is pending. The AP lets you re-enter the US without USCIS consider the AOS abandoned however AP is meant for emergency travel to home country.

From the above should I insinuate that my AP will probably be denied?

AP is not just for emergency travel and is almost ALWAYS approved - even if the person isn't eligible to use it.

Well, the form you fill out won't ask for pleasure/emergency situation if that's your concern. Getting it approved isn't a dealbreaker either. You're not running a risk by travelling with AP in your hands however I would like to say guard it and know why you have it - som CBPs seem to give you a hard time, and it's initially up to them to let you in.

It actually asks for you to explain why you are requesting it, so I am being honest and put down every situation I might encounter in the near future. Which is not only emergencies. I would really want to get clear about what to do with this form as I want to send the packet on monday!!! :s and now I am stressed about this AP thing. Thanks so much guys for your help!!! So what do you put under the "explain why you need to AP?"

If you read again, it says for people who are applying based on a I-485 application, that they do not need to explain the purpose.
